Highlights of Notable Documents from the Past Week (from November 19, 2023 to November 24, 2023)

During the past week, the Legal Secretary has updated numerous new documents, notably documents on health, banking, and state organization as follows:

  1. Regulations on Health Insurance Payment for Cancer Treatment Drugs

On October 30, 2018, the Ministry of Health issued Circular 30/2018/TT-BYT, stipulating the list, proportion, and payment conditions for chemical drugs, biological products, radiopharmaceuticals, and markers within the scope of healthcare entitlements for participants of health insurance (HI).

The HI fund will cover cancer treatment drugs used in treating cancer at medical establishments with cancer treatment functions, prescribed by doctors who hold practice certificates with a specialization in oncology or hematology and blood transfusion.

In the case of using these drugs to treat non-cancer diseases:- The HI fund will pay according to the Ministry of Health's or hospital's diagnostic and treatment guidelines;- If there are no available diagnostic and treatment guidelines, a consultation with a specialized oncologist is required;- If there are no available diagnostic and treatment guidelines and no specialized oncologist is available, a consultation chaired by the hospital leadership is required before prescribing the drug.

Circular 30/2018/TT-BYT takes effect from January 1, 2019.

  1. Guidance on Patients Registering for Free Drug Support Programs

The Ministry of Health issued Circular 31/2018/TT-BYT on implementing the free drug support program for medical establishments to treat patients.

Patients undergoing treatment at healthcare facilities can voluntarily register to participate in the drug support program organized by pharmaceutical businesses and must commit to the following:- Adhere to the medical examination schedule and perform necessary tests as required by doctors;- Comply with the regulations on receiving and using supportive drugs as notified when registering for the Program; only use the drugs for the Program's purposes and not for any other purposes;- Inform the treating doctor of any unwanted side effects, abnormal signs, or symptoms encountered during drug use;- Do not abandon treatment...

Circular 31/2018/TT-BYT takes effect from January 1, 2019.

  1. Transaction Counter Area of State Bank Branches in Provinces Up to 50 m²

On October 25, 2018, the State Bank issued Decision 2074/QD-NHNN, which stipulates the standards and norms for the use of office space for the State Bank's provincial/city branches.

The maximum specialized area norms for the State Bank's provincial/city branches are regulated as follows:- Transaction counter: 50 m²;- Transaction hall: 350 m²;- Citizen reception room: 40 m²;- Large meeting hall: 350 m²;- Counting room: 50 m²;- Operations warehouse: 100 m².

  1. Contents of the Administrative Organization Establishment Scheme

Decree 158/2018/ND-CP, which regulates the establishment, reorganization, and dissolution of administrative organizations, officially takes effect from January 10, 2019.

The regulation outlines the contents of the Scheme to establish an administrative organization as follows:- Necessity and legal basis;- Objectives, scope, and management subjects;- Type and name of the administrative organization;- Position, functions, tasks, powers, and organizational structure;- Explanation report on meeting the criteria for establishment as per legal regulations;- Projected job positions, official staff by job position, structure of officials by grade, ensuring accordance with functions, tasks, and powers; having office space, equipment, and necessary financial mechanisms to ensure operational capabilities after establishment;- Formulation plan and implementation roadmap for the administrative organization;- Suggestions from the agency or organization proposing the establishment of the administrative organization (if any);- Other contents as per specialized legal regulations and guidelines from the sectoral management ministry or field.
