During the past week (from January 21, 2023 to January 26, 2023), Thu Ky Luat has updated numerous new documents, notably including documents on auditing, enterprises, social policies, etc. such as:

  1. Individuals Conducting Internal Audits Must Have at Least 03 Years of Experience

The Government of Vietnam issued Decree 05/2019/ND-CP regulating internal audits in state agencies, public service providers, and enterprises, effective from April 01, 2019.

Individuals conducting internal audits must meet the following standards:

- Possess a university degree or higher in a field appropriate to auditing requirements, have comprehensive knowledge, and always stay updated on areas assigned for internal audit execution;- Have at least 05 years of experience in their trained specialty or at least 03 years of working at the current unit, or at least 03 years in auditing, accounting, or inspection;- Have general knowledge and understanding of laws and the unit's operations; the ability to collect, analyze, evaluate, and aggregate information; possess knowledge and skills in internal auditing;- Not have been disciplined at the warning level or higher due to violations in economic, financial, or accounting management or not currently serving any disciplinary actions;- And other standards.

  1. Guidelines for Salary Classification and Alignment for Dedicated Credit Guarantee Fund Managers

The Ministry of Labor, Invalids and Social Affairs (MOLISA) issued Circular 04/2019/TT-BLDTBXH guiding the management of labor, salaries, remuneration, and bonuses for the Credit Guarantee Fund for small and medium enterprises.

The regulation on salary classification and realignment for dedicated managers of the Credit Guarantee Fund is implemented according to Section 2 of Circular 27/2016/TT-BLDTBXH.

Based on the ranking standards (attached in the Appendix of Circular 04), the Credit Guarantee Fund determines the salary level policies and basic salary levels for dedicated managers.

Circular 04/2019/TT-BLDTBXH takes effect from March 08, 2019.

  1. Criteria for Identifying Villages Completing the Objectives of Program 135

On January 15, 2019, the Prime Minister of the Government of Vietnam signed Decision 03/2019/QD-TTg issuing criteria for identifying communes and villages achieving the objectives of Project 2 (Program 135) under the National Target Program for Sustainable Poverty Reduction for the period 2016 - 2020.

To be recognized as a village achieving the objectives of Program 135, the village must meet one of the following 03 criteria:

(1) Village in a commune recognized as meeting new rural standards or the village recognized as achieving new rural standards.

(2) Village with a total poverty and near-poverty rate of 55% (in the Southeast Region and the Mekong Delta Region from 30%) to less than 65% according to the multidimensional poverty approach for the period 2016 - 2020 and meet at least two of the three following conditions:- The main road in the village or inter-village road is hardened according to new rural criteria;- At least 60% of classrooms for kindergarten and nursery are built solidly;- There is a cultural house - village sports area.

(3) Village with a total poverty and near-poverty rate of less than 55% (in the Southeast Region and the Mekong Delta Region less than 30%) according to the multidimensional poverty approach for the period 2016 - 2020 and meet at least one of the three following conditions:- The main road in the village or inter-village road is hardened according to new rural criteria;- At least 60% of classrooms for kindergarten and nursery are built solidly;- There is a cultural house - village sports area.

Decision 03/2019/QD-TTg takes effect from March 01, 2019.

  1. Using the Crime Prevention Fund for Rewards and Assistance

According to Decision 04/2019/QD-TTg on the establishment, management, and use of the Crime Prevention Fund, the central Crime Prevention Fund is used for the following activities:

- Rewarding individuals and collectives with outstanding achievements in crime and drug prevention work. Specifically:- The maximum reward for an individual is 5,000,000 VND/person/reward;- The maximum reward for a collective is 20,000,000 VND/collective/reward.- Providing compensation and emergency relief for families and individuals directly involved in crime and drug prevention work who suffer loss of life, health, and property. The spending level is implemented according to Decree 103/2002/ND-CP.

Decision 04/2019/QD-TTg takes effect from March 10, 2019.
