Guidelines for Handling Old ID Cards When Switching to Citizen Identity Cards

The Ministry of Public Security has just issued Circular 40/2019/TT-BCA amending and supplementing certain provisions of Circular 07/2016/TT-BCA detailing certain provisions of the Law on Citizenship Identification and Decree 137/2015/ND-CP detailing certain provisions and measures for implementing the Law on Citizenship Identification.

When carrying out the procedure to change to a Citizen Identity Card (CCCD) while the People's Identity Card (CMND) is still clear, the receiving officer will issue an appointment slip to return the CCCD along with the uncut CMND for the citizen to use while waiting for the CCCD to be issued.

When returning the CCCD, the officer will request the citizen to submit the appointment slip and proceed to cut the top-right corner of the front side of the CMND, with each side of the right-angle triangle being 2 cm for the 9-digit CMND and 1.5 cm for the 12-digit CMND.

In the case where the citizen requests the CCCD to be delivered via postal service to a specified address, the managing agency for CCCD at the place of submission will proceed to cut the corner and return the cut CMND immediately after receiving the citizen's documents. In the event the CMND is damaged, peeling, or unclear, the CMND will be collected and destroyed, noted in the file, and a Certificate of CMND Number will be issued.

"Currently, Circular 07/2016/TT-BCA stipulates that the old CMND will be corner-cut when citizens carry out the procedure to switch to the CCCD. However, under the new regulation in Circular 40/2019/TT-BCA, the corner cutting of the CMND will be done when the officer returns the CCCD to the citizen. This ensures the integrity of the CMND, allowing citizens to carry out other procedures requiring the CMND during the waiting period for the CCCD," stated Lawyer Nguyen Thuy Han, in charge of the Law Community Network of LawSoft.
