Recently, the General Department of Customs issued Official Dispatch 5575/TCHQ-GSQL in 2020 regarding the certification of origin documents under the EVFTA Agreement.
while awaiting the promulgation of the Decree on preferential export tariff schedule, special preferential import tariff schedule for implementing the EVFTA Agreement, to ensure proper performance of the Agreement commitments, the General Department of Customs provides guidance as follows:
- For import customs declarations registered from August 1, 2020, if the customs declarants submit the certificate of origin issued from August 1, 2020, the Customs authority shall guide the customs declarants to declare information regarding the certificate of origin on the customs declaration according to the provisions of Article 5 of Circular 38/2018/TT-BTC (as amended and supplemented by Circular 62/2019/TT-BTC) and proceed according to regulations;- Regarding the application of the EU self-certification mechanism of origin under the EVFTA Agreement, according to the content of Official Dispatch 6123/BCT-XNK dated August 18, 2020, of the Ministry of Industry and Trade, based on the official notice of the EC in letter Ares (2020) and Circular 11/2020/TT-BCT, Vietnam will grant preferential treatment for consignments originating from the EU based on the self-certification of origin documentation issued by exporters registered with the REX (the EU control system) or by any exporter certifying for consignments valued not over 6,000 EURO;- The timing of submission of the certificate of origin under the EVFTA Agreement shall follow the provisions in Article 7 of Circular 38/2018/TT-BTC (as amended and supplemented by Circular 62/2019/TT-BTC).
