Recently, Hanoi City Social Insurance issued Official Dispatch No. 5251/BHXH-QLT providing temporary guidance on participation in compulsory social insurance according to Decree No. 143/2018/ND-CP.
Foreign employees are subject to mandatory social insurance participation if they: Have a work permit or practice certificate or practice license issued by a competent authority of Vietnam and have an indefinite-term contract or a definite-term labor contract of one year or more with a Vietnamese employer.
In addition to the benefits foreign employees are entitled to from December 1, 2018, such as sickness benefits, maternity benefits, occupational accident and disease benefits, from January 1, 2022, foreign employees are also entitled to the following benefits:
- Retirement and survivorship benefits as prescribed by Social Insurance Law;- Cases entitled to lump-sum social insurance benefits: Implemented according to Clause 6, Article 9 of Decree 143/2018/ND-CP.
From January 1, 2022, foreign employees are also required to contribute 8% of the salary used for social insurance calculation to the retirement and survivorship funds.
