Do Not Renew Old House Lease Contracts If the Lease Term Exceeds 5 Years

the Government of Vietnam has just issued Decree 30/2019/ND-CP amending and supplementing several articles of Decree 99/2015/ND-CP specifying and guiding the implementation of the Housing Law.

Fixed-term old house lease contracts are set at 05 years, starting from the contract signing date, except in cases where the lessee requests a shorter lease period.

Upon the expiration of the lease term, if the lessee still meets the conditions for leasing the house and wishes to continue leasing, the contract may be extended for a period equal to the previous lease term, except in cases where the house is reclaimed according to legal regulations.

Note that in cases where the lease contract was signed before May 15, 2019, with a lease term different from the term stipulated in Decree 30/2019/ND-CP, the parties are not required to re-sign the lease contract.

In the event that by May 15, 2019, the lease is up for renewal or re-signing, the lease term will be determined according to the provisions of Decree 30/2019/ND-CP.
