Recently, the Ministry of National Defense, the Ministry of Public Security and the Supreme People’s Procuracy of Vietnam has issued the Joint Circular No. 08/2021/TTLT-BQP-BCA-VKSNDTC on coordination in arrest, custody and supervision of arrest and custody of agencies and persons assigned to conduct a number of investigative activities by the Border Guard and the Coast Guard.
According to Article 6 of the Joint Circular No. 08/2021/TTLT-BQP-BCA-VKSNDTC of Vietnam, when detecting and receiving a red-handed offender, a wanted person, or an offender who confesses or surrenders, competent agencies and persons of the Border Guard or the Coast Guard must make a record of arrest the offenders, the wanted, make a record of the offenders' confession, surrender, protect the scene (if any), seize and temporarily seize weapons and weapons and preserve objects, relevant documents, take the original testimony; immediately bring that person to or immediately report to the competent investigating agency. If the competent investigating agency has not yet been identified, the person shall be immediately transported to the nearest police investigation agency.
Note: The competent investigating agency or the nearest police investigation agency shall receive persons and documents and evidence related to the case by a competent agency or person of the Border Guard, the Coast Guard forces hand over to handle according to the provisions of Vietnamese law.
