July 02, 2024, Hanoi issued Decree 79/2024/ND-CP amending Decree 121/2016/ND-CP on implementing the pilot management of labor and salary for the Viettel Group
Amending and supplementing a number of regulations on salary management for the Parent Company - Viettel Group.
Specifically, when determining the actual salary fund, the Parent Company - Viettel Group excludes the objective factors affecting profit and labor productivity in comparison to the profit and labor productivity of the previous year, including:
Carrying out security and defense tasks assigned by the State, the Ministry of National Defense or self-conducted research, production of security and defense products and services without or not yet generating revenue; (Previously regulated: Carrying out security and defense tasks assigned by the State and the Ministry of National Defense)
Producing and providing products and services priced by the State, but the price does not cover the costs according to the legal regulations on prices and related laws or the State adjusting the price lower than the contracted, ordered, or assigned price; (Previously regulated: The State adjusting the price (for products and services priced by the State)
Corporate income tax incentives; increasing or decreasing state capital; the State adjusting mechanisms, policies, or requiring the company to relocate, narrow production and business locations directly affecting the company's labor productivity and profit targets; carrying out political tasks, ensuring social security, balancing supply and demand for the economy as decided by the Prime Minister of the Government of Vietnam; receiving or transferring the authority to represent state capital ownership in restructuring enterprises, handling and restructuring debts under the Prime Minister's directives; new investments, expanding production and business; increasing depreciation to recover capital quickly according to legal regulations after being approved by the competent authority;
Being assigned an increased volume of security and defense products and services by the competent State authority compared to the previous year; directly affected by implementing enterprise restructuring projects according to the competent State authority's regulations; adjusting or newly arising provisions following regulations upon objective factors in the host country where the company invests in projects; adjusting operational policies at the competent State authority's request, according to international treaties signed on behalf of the State or the Government of Vietnam with foreign contracting parties; due to policy changes in the host country where the company invests in projects; market directly affecting the company's basic input production factors; (Newly supplemented content)
Natural disasters, fires, epidemics, wars, and other force majeure objective reasons.
