09 National Technical Regulations Related to Workplaces Effective from Early December

From December 01, 2016 to December 14, 2016, many new policies in the fields of labor and healthcare came into effect. Notably, there are 09 National Technical Regulations (NTR) related to workplaces that took effect from December 01, 2016:

  1. National Technical Regulation on High-Frequency Electromagnetic Fields - permissible exposure levels of high-frequency electromagnetic fields in the workplace issued together with Circular 21/2016/TT-BYT;
  2. National Technical Regulation on Lighting - permissible lighting levels in the workplace issued together with Circular 22/2016/TT-BYT;
  3. National Technical Regulation on Ultraviolet Radiation - permissible exposure levels of ultraviolet radiation in the workplace issued together with Circular 23/2016/TT-BYT;
  4. National Technical Regulation on Noise - permissible exposure levels of noise in the workplace issued together with Circular 24/2016/TT-BYT;
  5. National Technical Regulation on Industrial-Frequency Electromagnetic Fields - permissible exposure levels of industrial-frequency electromagnetic fields in the workplace issued together with Circular 25/2016/TT-BYT;
  6. National Technical Regulation on Microclimate - permissible microclimate values in the workplace issued together with Circular 26/2016/TT-BYT;
  7. National Technical Regulation on Vibration - permissible values in the workplace issued together with Circular 27/2016/TT-BYT;
  8. National Technical Regulation on Ionizing Radiation - permissible exposure dose limits of ionizing radiation in the workplace issued together with Circular 29/2016/TT-BYT;
  9. National Technical Regulation on X-Ray Radiation - permissible exposure dose limits of X-ray radiation in the workplace issued together with Circular 30/2016/TT-BYT;

Additionally, many new policies in the labor field take effect from the beginning of December as follows:

  1. Conditions for Supporting Training for Laid-off Workers

According to Circular 152/2016/TT-BTC (effective from December 04, 2016), workers who fall under the provisions of Article 2 of Decision 46/2015/QD-TTg and lose their jobs will receive state-supported training when meeting the conditions:

In cases of working under a contract with one of the following documents:

- Decision of termination, enforced termination;- Dismissal decision; notification or agreement on termination of labor contract, employment contract;- Expired labor contract or employment contract or completed work according to the labor contract;- In case of not working under a contract: Employer's confirmation;- In case of self-employment: Valid business registration certificate or confirmation from the Commune People's Committee (in case there is no business registration).

Simultaneously, the Circular also stipulates conditions for training support for rural workers, disabled persons, those who have been supported in training but lost their jobs, and members of households whose agricultural or business land is reclaimed.

  1. Guidance on Calculating Hazard Allowance for Work at Martyrs' Cemetery

Circular 30/2016/TT-BLDTBXH guides the implementation of policies on hazardous and dangerous allowances for those working in cemetery management at martyrs' cemeteries effective December 10, 2016.

The hazardous and dangerous allowance is calculated based on the actual working time at places with hazardous and dangerous factors:

- Working under 4 hours/day: calculated as 1/2 working day;- Working from 4 hours onward: calculated as a full working day.

The hazardous and dangerous allowance is paid along with the monthly salary and is not used to calculate social insurance benefits.
