1. Regulations on the registration of artels, cooperatives, and cooperative unions under contingency procedures

According to Article 20 of Decree 92/2024/ND-CP, the issuance of registration for artels, cooperatives, and cooperative unions according to the backup process is as follows:

- Issuing the registration for artels, cooperatives, and cooperative unions according to the backup process is done without the Cooperative Registration Information System. This method is applied in the following cases:

+ The Cooperative Registration Information System is under construction or upgrading;

+ The Cooperative Registration Information System or the taxpayer registration application system encounters a technical issue;

+ Other force majeure cases.

- Based on the expected time to resolve the issue or construct, upgrade the Cooperative Registration Information System, the Ministry of Planning and Investment will notify the expected time for district-level business registration agency to perform the registration process as a backup, except in cases of force majeure.

- The coordination in resolving the registration issuance for artels, cooperatives, and cooperative unions according to the backup process between the district-level business registration agency and the tax authority will follow the process of transferring documents in paper form or other means.

- Within 30 days from the notification by the Ministry of Planning and Investment of the completion of construction, upgrading, or issue resolution of the Cooperative Registration Information System, the district-level business registration agency must update the data and information issued to artels, cooperatives, and cooperative unions according to the backup process into the Cooperative Registration Database.

2. Regulations on notification for amendment, supplementation of registration documents for artels, cooperatives, and cooperative unions in Vietnam

According to Article 21 of Decree 92/2024/ND-CP, the regulations on the notification for amendment, supplementation of registration documents for artels, cooperatives, and cooperative unions in Vietnam are as follows:

- In case the documents are not valid, or the name of the artels, cooperatives, and cooperative unions requested for registration is incorrect, or the information declared in the registration documents is inconsistent, the district-level business registration agency must notify in writing the content that needs amendment, supplementation to the founder of the artels, cooperatives, and cooperative unions within 3 working days from the receipt of the documents. The district-level business registration agency will list all the required amendments and supplements for each registration document set submitted by the artels, cooperatives, and cooperative unions in one notification for amendment, supplementation.

- If the above time limit is exceeded and the district-level business registration agency has not issued the registration or has not issued a notification of required amendments, supplements to the registration documents, the founder of the artels, cooperatives, and cooperative unions has the right to file a complaint according to legal regulations on complaints and denunciations.
