New regulations on assessment and grading of Vietnamese officials and public employees

The Vietnam Ministry of Home Affairs is seeking public comments on the Draft Decree replacing Decree 56/2015/ND-CP on assessment and grading of Vietnamese officials and public employees (as amended and supplemented by Decree 88/2017/ND-CP).

Currently, according to Decree 56/20105/ND-CP, the assessment of Vietnamese official and public employees is based on 4 levels, including:

- Excellent completion of tasks;

- Successful completion of tasks;

- Completion of tasks with limited capability;

- Non-completion of tasks.

Among these, the completion of tasks with limited capability differs from Regulation 89-QD/TW on the assessment and grading of leaders.

Therefore, to align with Regulation 89-QD/TW, in the Draft Decree, the Vietnam Ministry of Home Affairs proposes regulating the "Completion of tasks" to replace the "Completion of tasks with limited capability".

Thus, the assessment levels for grading officials will be based on the following new criteria:

Level 1: Excellent completion of tasks

(1) Truly exemplary in observing the regulations on politics, ethics, lifestyle, work style, and organizational discipline in clauses 1, 2, 3, and 4 of Article 5;

(2) Effectively implement the regulations at point a of clause 5 of Article 5 of the Decree;

(3) Maintain discipline and order in the agency, organization, unit; ensure no disciplinary or legal violations occur within the scope of management;

(4) Be dedicated and responsible in work; dare to think, dare to do, dare to take responsibility in performing the assigned tasks;

(5) Lead, direct, and manage the agencies, organizations, units, or sectors under their charge to complete all targets and tasks, with at least 50% of the basic targets exceeded; 100% of the agencies, units under direct leadership, management are rated as completing tasks, with at least 70% of the units completing tasks well or better;

(6) Lead, direct administrative reforms, reform public service policies, and officials achieving good results, having a direct impact on improving the efficiency and effectiveness of the activities of the agency, organization, unit, or sector in charge;

(7) Have initiatives and specific solutions that are applied, improving the efficiency and effectiveness of the agencies, organizations, or sectors in charge, and recognized by competent authorities.**

Level 2: Successful completion of tasks

(1) Exemplary in observing the regulations at Clauses 1, 2, 3, 4 of Article 5;

(2) Effectively implement the criteria (2), (3), (4) of Level 1;

(3) Lead, direct, and manage the agencies, organizations, units, or sectors under their charge to complete the assigned tasks well;

(4) The agencies, organizations, and units under their charge complete all targets and tasks, with at least 80% completed on time and ensuring quality, 100% of the agencies, units under direct leadership, and management are rated as completing tasks or better;

(5) Lead, and direct administrative reforms, reform public service policies, and officials achieving results, impacting the efficiency and effectiveness of the activities of the agency, organization, unit, or sector in charge.

Level 3: Completion of tasks

(1) Exemplary in observing the regulations at Clauses 1, 2, 3, 4 of Article 5;

(2) Effectively implement the criteria (2), (3), (4);

(3) Lead, direct, and manage the agencies, organizations, units, or sectors under their charge to complete the assigned tasks but with a maximum of 20% criteria not ensuring quality, progress, or inefficiency;

(4) The units under their charge complete over 70% of the targets and tasks. At least 70% of the agencies, units under direct leadership, and management are rated as completing tasks;

(5) Lead, direct administrative reforms, and reform public service policies and officials to achieve results.

Level 4: Non-Completion of tasks

(1) Competent authority evaluates the official as showing signs of degradation in political ideology, ethics, lifestyle, self-evolution, and self-transformation;

(2) Over 50% of the criteria for the responsibilities and tasks are rated as not completed;

(3) The agencies, and units under their charge complete less than 50% of the assigned or set targets and tasks;

(4) The agencies, units under direct leadership, and management are involved in embezzlement, and corruption, and disciplined according to the law;

(5) The individual is disciplined in the year of assessment.
