On November 15, 2024, the Minister of Transport of Vietnam issued Circular 43/2024/TT-BGTVT guiding Decree 57/2024/ND-CP on the management of dredging activities in maritime port waters and inland waterway areas.
The surveying and measuring of public maritime routes and inland waterways during maintenance dredging based on implementation quality in Vietnam is conducted according to the provisions of Article 6 of Circular 43/2024/TT-BGTVT as follows:
- The regular and ad-hoc surveys and measurements of the route are conducted during the contract period for carrying out maintenance dredging of public maritime routes and inland waterways to serve inspection, supervision, and exploitation.
- Regular surveying and measurement of the route are carried out according to the survey frequency approved by the competent authority.
- The investor decides the number of ad-hoc surveys and measurements, but not exceeding 03 times per year; the scope of each survey and measurement is designated by the investor with a maximum area of 30% of the surface area of the route. In cases where the regular survey and measurement frequency of the route is > 03 times per year, the data from the regular surveys of the route is used for inspection, supervision, and exploitation.
In cases where the regular survey and measurement frequency of the route is ≤ 03 times per year, additional ad-hoc surveys and measurements are added to serve inspection, supervision, and exploitation. The timing of regular surveys and measurements is at least every 03 months or as required by the investor in cases of force majeure events affecting the channel standards.
Additionally, the maintenance dredging of public maritime routes and inland waterways based on implementation quality is based on the contents specified in Clause 1, Article 4 of Circular 43/2024/TT-BGTVT as follows:
- The importance of the route to maritime and inland waterway activities, the potential for exploiting seaports (for public maritime routes), ports, and inland waterway berths (for inland waterways) to support socio-economic development;
- Statistical data on cargo volume; the number, types, and sizes of sea vessels (for public maritime routes), inland waterway vehicles (for inland waterways) passing through the port, and berths on public maritime routes and inland waterways over the past 03 years;
- The evolution of sedimentation, maintenance dredging results over the past minimum of 03 years;
- The plan for areas and locations receiving dredged material.
