On November 30, 2024, the Prime Minister of the Government of Vietnam issued Official Telegram 124/CD-TTg to intensify the acceleration of state budget revenue collection for land-related revenues in the last month of 2024.

Intensifying the urging of state budget revenue collection for land-related receivables in the final month of 2024 in Vietnam

To contribute to fulfilling the state budget revenue task at the highest level, laying the groundwork for successfully carrying out economic and social development tasks in 2025 and the 2026-2030 period, the Prime Minister of the Government of Vietnam requests:

(1) The Ministry of Finance is to take the lead, in cooperation with relevant agencies:

- Direct the tax authorities to enhance tax management measures, strictly control tax calculation, tax declaration, and tax payment, ensuring full and correct collection of all arising revenues as per tax laws, and prevent revenue loss for state budget revenue.

- Review and promptly urge the payment into state budget revenue of tax amounts and land rent that have been deferred according to Decree 64/2024/ND-CP dated June 17, 2024, on extending the payment deadlines for value-added tax, corporate income tax, personal income tax, and land rent in 2024, and Decree 65/2024/ND-CP dated June 17, 2024, on extending the deadline for paying special consumption tax for domestically produced or assembled automobiles when the extension period ends.

- Continue to rigorously implement directives on enhancing disciplinary measures, fiscal discipline in state budget management, intensify inspection and auditing to prevent loss and aggressively recover tax arrears.

- Instruct the tax authorities to promptly collaborate with relevant local departments and agencies to advise the People's Committees of provinces and cities to promptly address, resolve difficulties, and obstacles related to procedures and pricing for real estate projects, accelerate public investment capital disbursement, organize auctions, land allocations, and leases, and promptly urge the payment into state budget revenue of arising revenue in compliance with budget law; enhance efforts to prevent revenue loss in activities linked to real estate transactions involving price discrepancies to promote a healthy real estate market; comprehensively review overdue projects, tally up outstanding land levies, and summarize reports to the People's Committees at all levels to direct relevant agencies to focus on overcoming obstacles to promptly recover tax arrears and land levy debts into state budget revenue. For cases willfully delaying execution, advise the provincial and city People's Committees to revoke the project in accordance with the law.

- Instruct tax authorities and State Treasury to deploy personnel to operate the 24/7 information technology system during the last month of 2024 to support taxpayers in fulfilling their obligations to state budget revenue promptly.

(2) The Ministry of Natural Resources and Environment takes the lead, in cooperation with relevant agencies:

- Continue organizing training, communication, dissemination, and guidance for localities regarding the provisions of the Land Law; closely monitor the organization and implementation of the Land Law throughout the country; collate difficulties and obstacles to handle and resolve within its jurisdiction and report contents beyond its authority.

- Urge localities to swiftly complete issuing detailed regulatory documents implementing the Land Law within their authority, and construct and announce new land price lists to facilitate the effective, prompt implementation of land auctions and allocations, and prevent state budget revenue revenue losses.

- Intensify inspections, supervision, and law enforcement actions regarding state management agencies and land users in localities.

(3) The Ministry of Construction takes the lead, in cooperation with relevant agencies:

- Continue maximizing the effectiveness of the Prime Minister's Task Force established under Decision 1435/QD-TTg dated November 17, 2022, by the Prime Minister of the Government of Vietnam.

- Review, urge, and guide the resolution of difficulties and obstacles in real estate project implementation for localities and enterprises, especially regarding legalities, planning, projects with good liquidity, commercial housing projects, social housing, new urban areas, etc., to thereby create and stimulate the development of the real estate market, attract major investment projects, and create additional revenue streams for state budget revenue.

(4) The Ministry of Planning and Investment is to lead, in cooperation with relevant agencies:

Continue addressing institutional difficulties and obstacles, promptly provide guidance, and urge the resolution of arising issues, expedite the construction and completion of key transportation infrastructure projects, national pivotal projects, and inter-regional connectivity projects, ensuring they come online according to schedule, thus enhancing and increasing the value of auctioned land parcels in localities, exploiting additional revenue from land resources.

(5) The State Bank of Vietnam takes the lead, in cooperation with relevant agencies:

- Implement well Official Telegram 122/CD-TTg dated November 27, 2024, about enhancing solutions for managing credit in 2024.

- Direct commercial banks to continue reviewing and cutting unsuitable administrative procedures, making it easier for real estate businesses and home buyers to access credit, fostering a sustainable real estate market, and creating a source of revenue for state budget revenue.

(6) The Chairpersons of the People's Committees of centrally-run provinces and cities:

- Accelerate the establishment of comprehensive and detailed planning as a basis for effectively, appropriately, consistently, and modernly implementing real estate projects.

- Urge the timely issuance of complete land price lists and other detailed regulations provided in the Land Law and its guiding documents; Direct the Department of Natural Resources and Environment, Department of Finance, and Department of Construction to work in collaboration with other related departments, branches, and sectors to organize effectively the compensation, support, and resettlement operations; focus on well-conducted appraisal work, determining land prices; expedite the auctioning process for land use and leasing rights for projects that meet the conditions to allow tax authorities to promptly urge payment into state budget revenue for land-related revenues in the locality.

- Actively direct the review and clearly determine the number of backlogged land records, the causes, solutions, and specify the responsibilities of related organizations and individuals; review real estate projects underway in the locality that have legal, planning, investment, construction, compensation, clearance, and other issues, to promptly resolve difficulties and report to competent authorities those issues beyond the scope of resolution.

- Decisively direct departments, agencies, and sectors to review projects with land allocation decisions, without obstacles but with slow or non-implementation by investors or failure to fulfill financial obligations concerning land, to organize recovery per land law, and select capable investors for implementation, combating waste.

- Enhance monitoring and supervision of the real estate market situation in the locality to promptly devise fitting measures and solutions for stabilizing conditions and maintain a safe, healthy, and sustainable market.

- Continue maintaining and intensifying the activities of the Anti-Revenue Loss and Tax Debt Recovery Steering Committee, direct sectors and levels in localities to closely coordinate with taxation authorities in managing and combating revenue loss, recover outstanding debts related to land revenue, and increase state budget revenue revenue, striving to complete the state budget revenue revenue task at the highest level.

(7) Ministries, ministerial-level agencies, government-affiliated agencies, and localities:

- Based on assigned functions and tasks, closely coordinate with relevant ministries, agencies, and provincial/city People's Committees to effectively implement the government’s directives and instructions on socio-economic development, state budget management, and sustainable, safe, and healthy real estate market development; promptly accelerate public investment disbursement for projects under management, thereby encouraging real estate market development.

- intensify discipline, urgency in disseminating directives to every unit, officials, and public employees for diligently executing the Prime Minister's instructions; immediately rectify avoidance, passing of tasks, fear of responsibility, reluctance to provide advice, propose solutions, shorten processing time, enhance directive effectiveness and efficiency. Strictly handle organizations and individuals deliberately avoiding, passing jobs, shirking duties, failing responsibilities, leading to delays or indecision on delegated issues. Promptly commend and reward entities and individuals executing assigned duties well, protecting diligent and innovative cadres acting for common benefit.

(8) The Prime Minister of the Government of Vietnam assigns Deputy Prime Minister of the Government of Vietnam Ho Duc Phoc to direct, accelerate and effectively organize the implementation of this Official Telegram; report to the Prime Minister of the Government of Vietnam on issues beyond his authority.
