On November 13, 2024, the Minister of Public Security of Vietnam issued Circular 72/2024/TT-BCA which prescribes the procedures for investigating and resolving road traffic accidents by the Traffic Police, including regulations on reconstructing the scene of road traffic accidents.
The reconstruction of the scene of road traffic accidents in Vietnam is conducted in accordance with the provisions of Article 15 of Circular 72/2024/TT-BCA as follows:
- During the investigation and verification of a road traffic accident, if there are grounds to determine that the scene has been disrupted, falsified, or it is deemed necessary for the investigation, verification, and resolution of the road traffic accident, a reconstruction of the scene should be organized. The reconstruction must follow a Scene Reconstruction Plan according to Form number 16/TNDB issued with Circular 72/2024/TT-BCA and must be approved by the appropriate authority.
- The content of the scene reconstruction should re-establish the positions of the victims, objects, vehicles, and traces at the scene, review situations, actions, and circumstances when the road traffic accident occurred; measure and redraw the scene diagram; take photographs for comparison purposes.
- At the conclusion of the road traffic accident scene reconstruction, a Record of Scene Examination of the reconstruction must be made, and the Redrawn Diagram of the road traffic accident scene must be included; participants in the scene reconstruction must sign and clearly write their names in the record and diagram.
Note: A road traffic accident refers to a collision involving people and vehicles participating in road traffic, occurring unintentionally by road traffic participants, causing harm to the life, health, or property of individuals or assets of agencies and organizations.
