Below is notable content in the Draft Decree adjusting pensions, social insurance benefits, and monthly benefits in Vietnam that is being released for collecting comments online.
Proposal to increase pensions and benefits by 15% for 8 groups of officials, public employees, and workers as of January 1, 2022 in Vietnam
From January 1, 2022, an increase of 15% on pension, social insurance benefits, and monthly benefits in Vietnam in December 2021 will be adjusted for the following subjects:
(1) Officials, civil servants, workers, public employees, and employees (including people who have participated in voluntary social insurance, retirees from the Nghe An farmers' social insurance fund and transferred to according to Decision 41/2009/QD-TTg dated March 16, 2009 of the Prime Minister on converting Nghe An farmer social insurance to voluntary social insurance); military personnel, people's police, and cipher workers are receiving monthly pensions.
(2) Commune, ward and town officials specified in Decree 92/2009/ND-CP dated October 22, 2009 of the Government on titles, numbers, a number of regimes and policies for officials and civil servants in communes, wards, towns and those working part-time at the commune level, Decree 34/2019/ND-CP dated April 24, 2019 of the Government amending and supplementing a number of regulations on commune-level officials and civil servants and part-time workers at the commune level, in villages and residential groups, Decree 121/2003/ND-CP dated October 21, 2003 of the Government on regimes and policies for officials and civil servants in communes, wards and towns and Decree 09/1998/ND-CP dated January 23, 1998 of the Government amending and supplementing Decree 50/CP dated July 26, 1995 of the Government on living expenses for commune, ward and town officials who are receiving pensions and monthly benefits.
(3) People who are receiving monthly disability benefits according to the provisions of law; People who are receiving monthly benefits according to Decision 91/2000/QD-TTg dated August 4, 2000 of the Prime Minister on subsidies for people who have reached the end of working age at the time of stopping receiving monthly disability benefits, Decision 613/QD-TTg dated May 6, 2010 of the Prime Minister on monthly allowances for people with 15 to less than 20 years of actual working experience and the time limit for loss of working capacity allowance has expired; Rubber workers are receiving monthly benefits according to Decision 206/CP dated May 30, 1979 of the Government Council on policies for newly liberated workers who work in heavy, health-damaging jobs and now have to quit their jobs when they are old and weak.
(4) Commune, ward, and town officials are receiving monthly benefits according to Decision 130/CP dated June 20, 1975, of the Government Council supplementing policies and remuneration regimes for commune officials and Decision 111-HDBT dated October 13, 1981, of the Council of Ministers amending and supplementing a number of policies and regimes for commune and ward officials.
(5) Military personnel are receiving monthly allowances according to Decision 142/2008/QD-TTg dated October 27, 2008 of the Prime Minister on implementation of the regime for soldiers participating in the resistance war against the US to save the country with less than 20 years of service in the army who have been demobilized and returned to their localities, Decision 38/2010/QD-TTg dated May 6, 2010 of the Prime Minister on amending and supplementing Decision 142/2008/QD-TTg dated October 27, 2008 of the Prime Minister on the implementation of regimes for soldiers participating in the resistance war against the US to save the country with less than 20 years of service in the army, who have been demobilized and returned to their localities.
(6) The People's Public Security is receiving a monthly allowance according to Decision 53/2010/QD-TTg dated August 20, 2010 of the Prime Minister, on the regime for People's Public Security officers and soldiers participating in the resistance war against the US with less than 20 years of service in the People's Police who have quit their jobs and returned to their localities.
(7) Military personnel, people's police, and people doing cipher work are paid the same as military personnel and people's police who are receiving monthly benefits according to Decision 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister on regimes and policies for those who participated in the war to protect the Fatherland, performed international missions in Cambodia, and helped Laos after April 30, 1975, were demobilized, demobilized, or quit their jobs.
(8) People receiving monthly labor accident or occupational disease benefits.
According to this Draft, people whose pension, disability allowance, and monthly allowance after adjustment according to the above regulations are lower than 2.5 million VND/month will have the specific adjustment as follows:
- Increase by 200,000 VND/person/month for those with monthly pensions and benefits of 2,300,000 VND/person/month or less;
- Increase by 2,500,000 VND/person/month for people with monthly pensions and benefits from 2,300,000 VND/person/month to less than 2,500,000 VND/person/month.
It is expected that the Draft Decree will take effect on January 1, 2022, and replace Decree 44/2019/ND-CP.
