Vietnam: Financial support for people whose houses are collapsed or severely damaged by storms and floods

In recent days, people in the central region are suffering heavy consequences because of storms and floods that cause great damage to people, property and houses. The Prime Minister Nguyen Xuan Phuc has also requested financial support for people to repair badly collapsed and damaged houses.

On October 30, at the regular meeting in October 2020, the Prime Minister Nguyen Xuan Phuc stated: “The government has the responsibility to assist the provinces in difficulty with the available resources; request the responsible authorities to organize the necessary support forces, launch industry-wide measures to bring people's lives back to normal such as securing traffic, rebuilding homes, sending students back to school, etc.

Concurrently, the Prime Minister of Vietnam also asked the Steering Committee for Natural Disaster Prevention and Control to soon summarize and propose to the Government the State's support for heavily damaged localities such as production support, social security, livelihood creation for people, which is the most important; support vegetable varieties, rice varieties, food, so that no people go hungry, especially prepare supplies and materials so that prices, from corrugated iron to tile, cement, are not pushed up.

The Prime Minister agreed to provide a necessary amount of money to households whose houses were collapsed or severely damaged, “what level of support do we propose for houses with damaged roofs in the provinces?”. The Ministry of Finance soon agreed with the Ministry of Agriculture and Rural Development to provide timely support to localities.

According to Article 15 of the Decree No. 136/2013/NĐ-CP of Vietnam’s Government, specific amount of support is as follows:

The poor households, near-poor households and the disadvantaged households whose houses are collapsed, drifted, burnt totally due to natural disaster, fire or other unforeseen reasons and no longer have their residence shall be provided with financial support for house building with a maximum support rate of no more than 20,000,000 dong/household.

The households which must relocate as decided by the competent authorities due to the risk of landslide, flood, natural disaster, fire or other unforeseen reasons shall be provided with financial support for relocation with a maximum support rate of no more than 20,000,000 dong/household.

The poor households, near-poor households and the disadvantaged households whose houses are badly damaged by natural disaster, fire or other unforeseen reasons and such houses cannot be used for dwelling shall be provided with financial support for house repair with a maximum support rate of no more than 15,000,000 dong/household.

According to this regulation, people from poor households, near-poor households, and disadvantaged households whose houses are collapsed due to storms shall be provided with financial support with a maximum support rate of no more than 20,000,000 dong/household. In case the houses of these households are severely damaged, the maximum support level is not more than 15,000,000 dong/household. Thus, according to this regulation, households are supported when meeting the 2 following conditions:

1. Being poor households, near-poor households and the disadvantaged households;

2. Having houses collapsed, drifted or severely damaged due to natural disasters.

Households requested to relocate by competent authorities to prevent landslides shall be provided with financial support with a maximum support rate of no more than 20,000,000 dong/household.

Households subject to support shall prepare the Declaration to request the housing support and send it to the Chairman of communal People’s Committee. The order of housing support consideration shall comply with the provisions in Paragraph 3, Article 12 of Decree No. 136/2013/NĐ-CP.

The above is the opinion of LAWNET based on the provisions of current legal documents on support for house building and repair due to natural disasters. However, regarding the specific level of support, which households will be supported, at the request of the Prime Minister, the Ministry of Finance will soon agree with the Ministry of Agriculture and Rural Development to provide timely support to localities.
