Regarding this issue, LawNet would like to answer as follows:

1. What are information resources?

According to Clause 3, Article 3 of the Library Law 2019, information resources mean a collection of materials or data such as printed documents, handwritten documents, audiovisual materials, digital documents, microforms, including microfilms and microfiches, special documents for people with disabilities and other types of documents and data.

2. Restricted information resources in the library of Vietnam

Specifically, in Article 31 of Circular 02/2020/TT-BVHTTDL, information resources restricted to be used in libraries include:

(1) Information resources against the State of the Socialist Republic of Vietnam with the following contents:

- Misrepresenting the state's guidelines, policies, and laws; fabricating, causing public confusion;

- Defaming and denying the people's administration, distorting history, denying revolutionary achievements, insulting the nation;

- Causing psychological wars, inciting wars against the independence, sovereignty, and territorial integrity of the Socialist Republic of Vietnam.

- Creating divisions among people's classes, between the people and the people's administration, the people's armed forces, political organizations, and sociopolitical organizations.

(2) Information resources on ethnic and religious issues with the following contents:

- Instilling hatred, discrimination, division, and national separatism in the Vietnamese ethnic community;

- Inciting and dividing national and religious solidarity; causing division between religious adherents and non-religious people; between adherents of various religions; between religious adherents and the people's administration, political organizations, and socio-political organizations; offending beliefs, beliefs, and religions;

- Illegal religious organization activities; religious activities of organizations and individuals affecting national security

- Undermining the implementation of the policy of international solidarity.

(3) Information resources on social, political, cultural, and scientific issues with the following contents:

- Slandering or insulting the reputation of agencies or organizations, as well as individuals' honor and dignity;

- Inciting violence; propagating depraved lifestyles; providing detailed descriptions of lewd actions, criminal acts; being inconsistent with Vietnamese fine customs and traditions;

- Not disseminating projects, programs, plans, and scientific research on borders, national territorial sovereignty, national defense, and security; endangering the nation's or nation's interests;

- Promoting customs, superstitions, and superstitions; causing social confusion and negatively affecting social order, safety, and community health.

3. Principles of using restricted information resources in the library of Vietnam

The use of restricted information resources in the library is subject to the following guidelines:

- For limited-use information resources specified at Points a and b, Clause 1, Article 7 of the Library Law 2019, library users must comply with the following provisions:

+ Only used for scientific research purposes or political tasks approved by competent state agencies;

+ Must have a letter of recommendation, a written request from a state agency, governing organization, or political organization where you study, work, or live, or obtain written permission from the library's head in accordance with the library's regulations on the exploitation of limited information resources.

+ To comply with regulations on confidentiality in the process of exploiting information resources, not to copy, distribute, and disseminate information resources in cyberspace and other mass media;

+ Only read on site, in a separate room, according to the rules of the library.

- For limited-use information resources specified at Points c and d, Clause 1, Article 7 of the Library Law 2019, library users must use digital copies or copies according to the library's regulations.
