New regulations on granting and changing press cards from February 15, 2022

The Ministry of Information and Communications has issued Circular 31/2021/TT-BTTTT detailing and guiding the application and procedures for granting, changing, re-granting and withdrawing press cards. Accordingly, there are a number of new regulations on granting and changing press cards from February 15, 2022.

1. To be requested to issue or change an online journalist card

Pursuant to Article 5 of Circular 31/2021 stipulating how to submit the application for grant, change and re-issue of the journalist's card and return the journalist's card as follows:

- Agencies requesting the grant, change or re-grant of journalist's cards shall submit dossiers on the public service portal of the Ministry of Information and Communications.

- In case of ineligibility to submit the dossier on the Public Service Portal of the Ministry of Information and Communications, the agency requesting the grant, change or re-grant of a journalist's card shall send the dossier directly or via the postal system to the relevant agencies. organ:

+ Press Department (Ministry of Information and Communications) for subjects belonging to printed press agencies, printed magazines, electronic newspapers, electronic magazines, state management agencies in charge of press, and associations newspapers at all levels and lecturers specialized in journalism;

+ Department of Radio, Television and Electronic Information (Ministry of Information and Communications) for subjects operating in the field of radio and television.

- The Ministry of Information and Communications shall return the journalist's card directly at the above-mentioned agencies or via the postal system to the agency requesting the grant, change or re-issue of the journalist's card.

(Currently, it is only required to send dossiers to the following agencies: the Press Department or the Department of Radio, Television and Electronic Information according to regulations).

Thus, from February 15, 2002, the agency applying for the grant, change or re-issuance of a journalist's card is allowed to request the grant, change or re-issue of an online journalist's card.

2. Dossiers and procedures for granting press cards

Pursuant to Article 6 of Circular 31/2021 stipulating that the agency requesting the grant of a press card shall send 01 set of documents including:

- A declaration of registration for the grant of a journalist's card, made by the applicant, made according to the form (Form No. 01);

- An electronic copy (in case the application is submitted on the Public Service Portal of the Ministry of Information and Communications) or a copy (in the case of direct submission or via the postal system) University diploma or higher or College diploma or higher, for cases of ethnic minorities specified at Point b, Clause 1, Article 27 of the Law on Press (not applicable to cases of granting and renewing press cards for a new term);

(Compared with the current one, the electronic copy component is added for the case of submitting the application on the Public Service Portal of the Ministry of Information and Communications).

- An electronic copy (in case the application is submitted on the Public Service Portal of the Ministry of Information and Communications) or a copy (in the case of direct submission or via the postal system) of the Recruitment Decision or the Labor Contract Actions and other relevant documents (documents certified by the competent authority showing the time of paying social insurance premiums at the press agency, working agency or showing the payment and payment of salaries); /salary/remuneration/monthly royalties) to prove the continuous working time of 02 years or more at the press agency applying for the press card or at the district-level radio and television station and the like. equivalent;

(Compared with the current one, the electronic copy is added to the document component for the case of submission of documents on the Public Service Portal of the Ministry of Information and Communications. At the same time, more detailed regulations are required for other documents to certify documents. Proof of continuous working time of 02 years or more

- List of published and distributed journalistic works, for the cases specified in Clauses 5 and 6, Article 26 of the Press Law (Form No. 02);

- A summary of the list of requests for a journalist's card (Form 03).

Note : The agency applying for a journalist's card shall send a dossier before November 1 and April 21 every year, before September 1 of the last year of the journalist card's usage period to consider and issue a card (currently the 120 days before the expiry of the journalist card's expiry date specified on the card)

3. Dossiers and procedures for exchanging press cards

According to Article 7 of Circular 31/2021 , the press agency, the new working agency of the applicant for the change of the press card shall send 01 set of documents including:

- A written request of the press agency, the new working agency of the applicant for the change of the journalist's card (Form 04);

- An electronic copy (in case the application is submitted on the Public Service Portal of the Ministry of Information and Communications) or a copy (in the case of sending the application file directly or via the postal system) of the decision to accept the job or the contract. labor contract;

(Compared to the current supplementary electronic copy record component)

- The agency's document before the transfer, clearly stating the time of termination of work and confirming that the applicant for the change of the journalist's card does not fall into one or the cases specified at Points b, c, d and dd. Clause 3, Article 27 of the Law on Press (Form No. 05);

- List of published and distributed journalistic works, for the cases specified in Clauses 5 and 6, Article 26 of the Press Law (Form No. 02).

(Compared to the current one, the new regulation has removed the document component which is a copy of the journalist's card issued at the agency or unit before the job transfer).
