Law on the Capital: What are additional conditions for immigration to Hanoi?

On the afternoon of November 21, the National Assembly of Vietnam passed the Law on the Capital with 75% of the votes in favor. What's new in the regulations on immigration management in Hanoi?

The Law on the Capital 2012 of Vietnam consists of 7 chapters and 27 articles, effective from July 01, 2013. This Law has stipulated many policies on construction, development and management of the capital. Notably, Article 19 on management of immigration to the capital was amended according to option 1 of the draft.

Accordingly, basically keeping the conditions for registration of permanent residence as prescribed by the Law on Residence of Vietnam for cases of being transferred or recruited to work at agencies or organizations receiving salaries from the state budget, working under an employment contract, an indefinite-term employment contract, living with relatives or having previously had a household registration in the inner city, etc.

The cases must have temporarily resided in the urban areas for at least 3 years, owned or rented houses in urban areas of organizations and individuals that have applied for housing business registration; for houses for lease must satisfy the conditions for average area as prescribed by the People’s Council of Hanoi city, and the registration for permanent residence at the leased housed must be approved in writing by the lessors.

The content of immigration management has caused mixed opinions in the National Assembly, there are still 106 deputies who disagree, accounting for 21%.

Previously, the draft law designed two options to regulate the conditions for registration of "import" into the inner city of Hanoi. Option 1, raising the conditions of continuous temporary residence in the inner city from 1 to 3 years, having houses under their ownership or renting houses from individuals or organizations licensed to do business, having registered for permanent residence in the place of temporary residence, etc.

Option 2 adds stricter housing conditions: if it is a rented house, it must ensure a minimum area of ​​5m2/person. However, option 2, which is said to be too tight, has been removed, and the draft Law is revised according to option 1.

The National Assembly Standing Committee said that this plan basically preserves the conditions for registration of permanent residence as prescribed by the Law on Residence of Vietnam for cases of being transferred or recruited to work at agencies or organizations receiving salaries from the state budget, working under an employment contract, an indefinite-term employment contract, living with relatives or having previously had a household registration in the inner city, etc.

The Law on the Capital 2012 of Vietnam only supplements conditions of residence time and accommodation for some subjects who do not fall into these cases. According to the results of the opinion poll, 289/363 delegates agreed with this "slight tightening" regulation.

Voting separately on this content, 346 delegates voted "yes", accounting for 69%. However, there were still 106 delegates who voted "against", accounting for 21.29%. There were 11 non-voting delegates.

This is also the content passed with the lowest approval rate among the contents voted on (the position and roles of the capital; symbol of the capital; Plan for the construction and development of the capital; policies and mechanism; population management).
