Regarding this issue, LawNet would like to answer as follows:

1. Who is the Mobile Police?

According to Article 3 of the Law on Mobile Police 2022, the mobile police are the people's armed forces of the Vietnam People's Public Security, the core force in the implementation of armed measures to protect national security and ensure social order and safety.

2. Tasks and powers of the Mobile Police when patrolling and controlling in Vietnam

2.1. Tasks of Mobile Police when performing patrol and control

According to Article 7 of Circular 54/2022/TT-BCA, mobile police, when performing patrol and control, have the following tasks:

- Strictly abiding by the command and direction of the superior and the plan of patrol and control approved by the competent authority.

- Ensuring security and order within the geographical area, area, target, patrol, and control routes; detecting, preventing, and handling violations of the law; or requesting competent persons to promptly and strictly handle violations of the law.

- Coordinating with professional units of People's Public Security and local police to fight against crime and other illegal acts in the areas, targets, and routes assigned to patrol and control.

- Report and propose competent authorities to propose relevant agencies and organizations to take timely measures to remedy loopholes and shortcomings in the state management of security and order.

- Guiding, propagating, and mobilizing the People to participate in ensuring security and order and obeying the law on security and order.

- Perform other Tasks as prescribed by law and the Ministry of Public Security.

2.2. Powers of Mobile Police when patrolling and controlling in Vietnam

When performing patrol and control, the Mobile Police have the following powers:

- Inspecting and controlling people, vehicles, objects, and documents as prescribed in Clause 4 of Article 12 of the Law on Mobile Police 2022.

- Detecting, preventing, and handling law violations according to their competence.

- Mobilize civil people, vehicles, and equipment from agencies, organizations, and individuals according to the provisions of Article 16 of the Law on Mobile Police 2022.

- Using weapons, explosives, supporting tools, technical means, and equipment in service of patrol and control activities in accordance with law and the Ministry of Public Security.

- Exercising other powers as prescribed by law and the Ministry of Public Security.

3. Principles of patrol and control activities in Vietnam

According to Article 3 of Circular 54/2022/TT-BCA, the principles of patrol and control activities include:

- Complying with the provisions of Circular 54/2022/TT-BCA, other relevant provisions of law, and the Ordinance of the People's Public Security; strictly implement plans and plans approved by competent authorities.

- Promptly detecting, preventing, and handling illegal acts; proactively suppressing people who obstruct or oppose official duty performers in accordance with the law.

- Officers and soldiers of the Mobile Police, when performing patrol and control activities, must use uniforms, police badges, pennants, badges, and identity cards of the People's Public Security in accordance with the law and the Ministry of Public Security.

- Officers and soldiers of the Mobile Police, when deployed to patrol and control activities, are entitled to a fostering regime as prescribed by law.

- When dealing with people and people who commit acts of violating the law on security and order, they must have proper and appropriate manners, attitudes, and culture.

- It is strictly forbidden to take advantage of patrol and control activities to harass and trouble the People, infringe upon the interests of the State, the lawful rights and interests of organizations and individuals, or commit other illegal acts.
