Some New Points of the Citizenship Law 2014

Regarding the National Database on Population and the Citizen Identification Database:

The National Database on Population is a collection of basic information about all Vietnamese citizens, standardized, digitized, stored, and managed using information infrastructure to serve state management and transactions of agencies, organizations, and individuals.

The Citizen Identification Database is a specialized database, consisting of information on the identification of Vietnamese citizens, which is digitized, stored, managed using information infrastructure, and is a part of the National Database on Population.

The requirements; the information collected, updated when building the aforementioned databases; the regulations on management, use, exploitation, provision, exchange, and responsibility of the related entities are specifically stipulated in Section 1, Section 2 Chapter II of the Law.

Regarding the details depicted on the Citizen Identification Card:

The Citizen Identification Card will be rectangular in shape, with rounded corners, 85.6 mm in length, 53.98 mm in width, and 0.76 mm in thickness.

The front side of the card features the national emblem of the Socialist Republic of Vietnam; the phrases Socialist Republic of Vietnam, Independence - Freedom - Happiness; the text "CCCD"; photograph, CCCD card number, surname, middle name, and birth name, date of birth, gender, nationality, native place, permanent residence; expiry date.

The back side of the card contains an information storage section that is encrypted; fingerprints, physical characteristics of the cardholder; date of issue; surname, middle name, and birth name, position, signature of the issuer and stamp with the national emblem of the issuing authority.

Regarding the value of the Citizen Identification Card:

The Citizen Identification Card is a personal document of Vietnamese citizens with value proving the citizen identification of the cardholder to conduct transactions within the territory of Vietnam.

The Citizen Identification Card can also be used in place of a passport when Vietnam and a foreign country sign a treaty or international agreement allowing citizens of the contracting countries to use the Citizen Identification Card in place of a passport within each other's territories. When a citizen presents the Citizen Identification Card upon the request of an authority, organization, or individual with authority, that authority, organization, or individual is not allowed to request additional documents certifying the information. The state protects the legitimate rights and interests of the citizen cardholder as per the law.

Regarding the subjects eligible for the Citizen Identification Card and the Citizen Identification Card number:

Vietnamese citizens from 14 years of age are issued a Citizen Identification Card, and the number on the Citizen Identification Card is the personal identification number. The Citizen Identification Card must be renewed three times, when a citizen turns 25, 40, and 60 years old. In cases where the Citizen Identification Card is issued, renewed, or reissued within 2 years before the ages specified above, it remains valid until the next age for renewal.

The cases for issuance, renewal, reissuance; the procedures and authority for issuance, renewal, reissuance of the Citizen Identification Card are stipulated in Section 2 Chapter III of the Law.

Regarding the fees for issuance, renewal, reissuance of the Citizen Identification Card:

People from 14 years old who apply for the Citizen Identification Card will not have to pay a fee. The state also does not collect fees for card renewals at the ages of 25, 40, and 60.

Citizens who apply for renewal or reissuance will need to pay a fee, specifically, the renewal fee is 50,000 VND/card, and the reissuance fee is 70,000 VND/card. Residents living in mountainous commune-level towns, border areas, island districts pay 50% of the stipulated fee. Cases such as parents, spouses, children under 18 years old of martyrs; wounded soldiers, people with policies equivalent to wounded soldiers; children under 18 years old of wounded soldiers and people with policies equivalent to wounded soldiers; sick soldiers; citizens belonging to commune-level towns in highland areas as defined by the Committee for Ethnic Affairs; citizens from poor households and citizens under 18 years old who are orphans without support are also among those exempted from fees for renewal, reissuance of the Citizen Identification Card.

Additionally, the Law stipulates that the identity cards issued before January 1, 2016, remain valid until their expiry date; citizens have the right to request conversion to Citizen Identification Cards. Legal documents issued with information from identity cards remain legally valid.

To ensure the synchronized implementation of the issuance of Citizen Identification Cards nationwide, the Ministry of Public Security has issued Circular No. 61/2015/TT-BCA dated November 16, 2015, prescribing the model of the Citizen Identification Card; Circular No. 170/2015/TT-BTC dated November 9, 2015, from the Ministry of Finance regulating the fees, fee collection, payment, and management policies for Citizen Identification Cards to guide the implementation of the Law on Citizen Identification.

Once the national database on population is completed, Citizen Identification Cards will be equipped with chips to become electronic citizen cards, helping citizens eliminate many types of personal documents during daily transactions.

To date, the following documents guiding The Law on Citizen Identification 2014 have been issued:

- Circular No. 61/2015/TT-BCA prescribing the model of the Citizen Identification Card.- Circular No. 170/2015/TT-BTC regulating the fees, fee collection, payment, and management policies for Citizen Identification Cards.
