From January 1, 2025, the procedures for issuance of permits for overloaded, oversized vehicles in Vietnam will be implemented in accordance with Circular 39/2024/TT-BGTVT.

On November 15, 2024, the Minister of Transport of Vietnam issued Circular 39/2024/TT-BGTVT which regulates load capacity, limits of roads; operation of oversized and overload vehicles, tracked vehicles on roads; oversized, super-heavy freight transportation; loading goods on road vehicles; issuance of operation permits for overload vehicles, oversized vehicles, tracked vehicles, and vehicles transporting oversized and super-heavy goods on roads.
Article 23 of Circular 39/2024/TT-BGTVT prescribes procedures for the issuance of operation permits for overload vehicles, oversized vehicles from January 1, 2025, as follows:
(1) Organizations or individuals submit one set of documents directly or via postal service or online public service system to the competent authority stipulated in Article 24 of Circular 39/2024/TT-BGTVT.
(2) Document components:
- Application form as per the templates in Appendix I, Appendix II issued together with Circular 39/2024/TT-BGTVT;
- A copy of the vehicle registration certificate or temporary registration (for motor vehicles, special-use vehicles as regulated in Clause 5, Article 39 of the Road Traffic Order and Safety Law);
- A copy of the technical safety and environmental protection inspection certificate or a copy of the vehicle's technical specifications provided by the manufacturer with the vehicle (for temporarily registered vehicles);
- Transportation plan including: route information (detailed and specific destinations and names of each road section, turning points); vehicle information; cargo information certified by the transport lessee, including dimensions in length, width, and height (L x W x H) in meters, mass; an extract of the transport contract or written assignment of the transportation unit by the lessee; survey result report; recommendations from competent authorities, organizations (for cases specified in Point b, c, and d, Clause 1, Article 22 of Circular 39/2024/TT-BGTVT);
- Completion report on road infrastructure strengthening (for cases requiring road infrastructure strengthening).
(3) Procedure for issuing vehicle operation permits:
(i) Receiving and checking document components
+ For direct submission: the competent authority checks the documents on the same working day. If documents are incomplete, guidance will be given in writing to allow organizations or individuals to supplement and complete documents; if complete, they are received and an appointment slip for result collection is issued.
+ For submissions by postal service or online: within 02 (two) working days from receiving the documents, the competent authority checks the documents.
If documents are incomplete, guidance will be given in writing to allow organizations or individuals to supplement and complete documents; if complete, documents are processed per the procedure in (ii).
(ii) Document appraisal and result issuance
Within 01 (one) working day from receiving complete documents as regulated, the competent authority issues the vehicle operation permit; if not issued, a written response explaining the reasons must be provided.
(4) On roads or road sections surveyed, designed, or reinforced (if any), the competent authority stipulated in Article 24 of Circular 39/2024/TT-BGTVT may use survey result reports, and completed road infrastructure strengthening reports within 06 (six) months from the report's issuance to support the issuance of operation permits for overload vehicles, oversized vehicles, or vehicles transporting oversized and super-heavy goods with parameters (including external dimensions, total vehicle mass, axle load, and axle group) equivalent to or smaller than previously permitted vehicles on the same road, road section.
