Recently, LawNet regularly receives many questions about the notice of stay under the new regulations. Here are quick answers to some questions about stay notification according to Residence Law 2020 of Vietnam a> (effective from July 1, 2021).
1. When to do a stay notification
Pursuant to Article 30 of the Residence Law 2020 of Vietnam, when someone comes to stay with a household or at a healthcare establishment, tourist accommodation establishment or other types of lodging, a member of the household or the representative of the establishment shall notify the person’s stay with the registration authority;
In case a person comes to stay in the place of residence of an absent individual or household, the person shall notify their stay with the registration authority.
2. Time to do a stay notification
Pursuant to Article 30 of the Residence Law 2020 of Vietnam, stay notification must be done before 11:00PM of the starting day of the stay period; if a person comes to stay after 11:00PM, their stay shall be notified before 08:00AM of the following day.
Note: Biological siblings, children, spouse, parents and grandparents coming to stay multiple times only need to notify their stay once.
2. Where to do a stay notification
Pursuant to Article 30 of the Residence Law 2020 of Vietnam, stay notification may be carried out in person, by phone or by electronic means or other means as per regulations from the Minister of Public Security of Vietnam.
3. Dossiers of stay notification
The Residence Law 2020 of Vietnam does not stipulate documents for stay notification.
However, the person making the notice of stay should bring his/her ID card or citizen identification card and household registration book to prove his/her identity when carrying out administrative procedures.
4. Information of a stay notification
Pursuant to Article 30 of the Residence Law 2020 of Vietnam, a stay notification includes:
- Full name;
- Identity card number or passport number of the staying person;
- Stay reason;
- Stay duration;
- Address of the hosting place.
5. Is there a fine for not notifying stay?
Pursuant to Article 8 of the Decree No. 167/2013/NĐ-CP on sanction of administrative violation in social security, order and safety, prevention and fighting of social evils, fire and domestic violence, violation of regulations on registration and management of residence is prescribed as following:
- A fine of between VND 100,000 and 300,000 shall be imposed for individuals or house holders do not comply with the regulations on announcement of temporary stay;
- A fine of between VND 1,000,000 and 2,000,000 shall be imposed for the business establishment of temporary stay that has not informed the police authority of the stay as prescribed when there are persons coming to stay.
