The Ministry of Industry and Trade is seeking comments on the Draft Circular on guiding the implementation of the Border Trade Agreement between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China. Notably, it includes regulations on business registration for traders and residents at border markets.
Applicable Entities:
- Vietnamese traders and border residents doing business at border markets.- Chinese traders and border residents doing business at border markets.
Procedure:
For Vietnamese traders and border residents doing business at border markets: Follow the provisions set forth in Decision 52/2015/QD-TTg.
For Chinese traders and border residents doing business at border markets:
- Submit 01 file directly or by post to the Department of Industry and Trade or the agency authorized by the Department of Industry and Trade (District People's Committee/ district-level town/ city). Includes:- Business registration application at the border market (as per form);- Contract or agreement for renting a stall, booth, kiosk, or shop at the market with a validity period of 01 year or more: 01 notarized copy;- Copy of valid border crossing documents of the border resident or legal representative of the trader (passport or border laissez-passer or frontier exit/entry laissez-passer or other valid exit/entry documents): 01 notarized copy;- Copy of the business registration certificate for the trader: 01 notarized copy;- Photo of the border resident or legal representative of the trader: 02 photos 3x4.- Within 10 working days, the Department of Industry and Trade or the authorized agency shall confirm the trader's business at the border market for a period of 01 year.
In case the file is incomplete, within 3 working days, the Department of Industry and Trade or the authorized agency shall send a written request for the trader or border resident to supplement.- Based on the local market demand, the ability to allocate business locations at the border market, the Department of Industry and Trade or the authorized agency shall consider and decide to refuse to confirm the trader's business at the border market in writing and state the reason.
