Procedures for adjusting urban and rural planning according to the Law on Urban and Rural Planning 2024 in Vietnam

According to the provisions of Article 47 of the Law on Urban and Rural Planning 2024, the procedures for adjusting urban and rural planning are implemented as follows:

- For the procedures of comprehensive adjustment of urban and rural planning:

+ The agency or organization responsible for organizing urban and rural planning as stipulated in Article 17 of the Law on Urban and Rural Planning 2024 reports to the competent authority for approval of urban and rural planning to consider approving the policy on comprehensive adjustment of urban and rural planning based on the report of planning review results;

+ Once approved by the competent authority on the policy, the organization, appraisal, approval, and announcement of comprehensive planning adjustment are carried out according to the process of organization, appraisal, approval, and announcement of planning as stipulated by the Law on Urban and Rural Planning 2024.

- For the procedures of partial adjustment of urban and rural planning:

+ The agency or organization responsible for organizing urban and rural planning as stipulated in Article 17 of the Law on Urban and Rural Planning 2024 is responsible for preparing the dossier for partial planning adjustment according to the Minister of Construction's regulations; organizing the collection of opinions on the content and plan for partial planning adjustment from relevant state management agencies, the residential community in the planning adjustment area, and surrounding affected areas in accordance with Article 37 of the Law on Urban and Rural Planning 2024;

+ The appraisal agency stipulated in Article 38 of the Law on Urban and Rural Planning 2024 conducts appraisal on the basis for planning preparation, conditions for adjustment, and content of partial planning adjustment;

+ The authority, organization competent for approving urban and rural planning as stipulated in Article 41 and Clause 2, Clause 3, Article 48 of the Law on Urban and Rural Planning 2024 decides to approve the partial planning adjustment. The approval decision for the partial adjustment of urban and rural planning must clearly show the adjusted contents and accompany the partial planning adjustment dossier;

+ The responsible agency, organization for organizing urban and rural planning is responsible for updating and reflecting the contents adjusted in the planning dossier. The content of partial urban and rural planning adjustment must be announced as per Article 50 of the Law on Urban and Rural Planning 2024.

- The Minister of Construction stipulates detailed dossiers for reviewing and adjusting urban and rural planning.

Note: Urban and Rural Planning is the determination, organization of space, architectural landscape, organization of technical infrastructure works, social infrastructure works, housing to create a suitable living environment for residents in cities, district-level towns, commune-level towns, new urban areas, districts, communes, functional areas. (According to Clause 6, Article 2 of the Law on Urban and Rural Planning 2024)
