Draft version 5 of the Law on Residence 2020 is currently being solicited for opinions at Conference of full-time National Assembly delegates in September 2020. The Draft Law on Residence 2020annuls the management of residents through Household Registration Books and Temporary Residence Books, and is expected to take effect in Vietnam on July 1, 2021.
Numbers of procedures no longer require household registration book in Vietnam from July 01, 2021
To be specific, Draft Law on Residence 2020 in its 5th revision abolished regulations on: Household Registration Book, Household Registration Book for families, Household Registration Book for individuals, separation of Household Registration Book, household transfer certificate, adjustments of changes in the Household Registration Book as per the Law on Residence 2006 (amended and supplemented in 2013). Additionally, it amends and supplements several other provisions related to the Household Registration Book, Temporary Residence Book such as: acts that are prohibited (renting, leasing, counterfeiting, modifying, falsifying contents of the Household Registration Book, Temporary Residence Book); the right to be issued, reissued, and replaced Household Registration Book, Temporary Residence Book; the responsibility to present the Household Registration Book, Temporary Residence Book when requested by agencies or competent persons; the responsibility of the registration and management authority to issue the Household Registration Book, Temporary Residence Book, etc. For example, Clause 6, Clause 7 of Article 2 of Draft Law on Residence 2020 changed the regulations on permanent residence registration and temporary residence registration in Vietnam as follows:
“6. Permanent residence registration is the act of citizens registering their permanent residence with the police of communes, wards, commune-level towns and having the information updated in the National database on residence, database on residence.”
“7. Temporary residence registration is the act of citizens registering their temporary residence with the police of communes, wards, commune-level towns and having the information updated in the National database on population, database on residence.”
Thus, it can be seen that the Draft Law on Residence 2020 has eliminated the Household Registration Book and Temporary Residence Book, replacing paper-based residence management (permanent residence, temporary residence) with digital management. Specifically, it replaces manual management by book with the use of personal identification numbers for access, update, and adjustment in the National Database on Population accessible via the internet.
If the National Assembly approves the Draft Law on Residence 2020, it will completely abolish the management of population using the Household Registration Book, Temporary Residence Book, and is expected to come into effect on July 1, 2021. Therefore, when carrying out administrative procedures that required the Household Registration Book, citizens will no longer need to prepare the Household Registration Book. Specifically, the following procedures:
- Procedures for renting old state-owned housing.
- Procedures for requesting funeral cost support.
- Procedures for requesting support for the cost of caring for, nurturing social protection beneficiaries.
- Procedures for requesting monthly social allowance.
- Procedures for requesting support for the cost of caring for individuals caring for severely disabled persons.
- Procedures for requesting support for the cost of caring for families with severely disabled persons.
- Procedures for admitting severely disabled persons for care in social protection institutions.
- Procedures for requesting support policies for students.
- Procedures for registering the actual adoption of a child.
- Procedures for issuing boarding school policies.
- Procedures for admission.
- Procedures for tuition fee exemption/reduction at public preschools, general education, vocational education, and public higher education institutions.
- Procedures for registering land use changes.
- Procedures for state compensation claims.
- Procedures for birth registration for those who have personal records.
- Procedures for re-registering birth.
- Procedures for proving eligibility for legal aid.
- Procedures for requesting a credit fund license.
- Procedures for tax exemption for real estate transfer.
- Procedures for issuing a certificate of eligibility for aquaculture business conditions.
- Procedures for issuing, amending, supplementing passports.
- Procedures for issuing border laissez-passers.
- Procedures for issuing laissez-passers for exit and entry.
- Procedures for vehicle registration.
- Procedures for transferring vehicle ownership or moving vehicles to other provinces or centrally-affiliated cities.
- Procedures for school enrollment in various types of education.
- ....
These are the administrative procedures for which citizens will no longer need to prepare a Household Registration Book starting from July 1, 2021, if the Draft Law is approved by the National Assembly. Therefore, citizens should stay updated with the latest information from relevant Ministries to get detailed information and specific guidance in the coming time to avoid wasting time when performing the above procedures in Vietnam.
