Can alcohol be sold near schools or hospitals? This is one of the questions many people are asking.

The sale of beer near schools or hospitals shall be sanctioned according to Article 31 of Decree No. 117/2020/ND-CP, specifically as follows:
"Article 31. Violation of regulations on sale and supply of wine, beer
1. A fine of between VND 1,000,000 and 3,000,000 shall be imposed for one of the following acts:
a) Selling or providing alcohol or beer to persons under 18 years of age;
b) Failing to post the notice of not selling wine, beer to persons under 18 years of age at the easy-to-see location of the facility selling wine, beer.
2. A fine of between VND 5,000,000 and 10,000,000 shall be imposed for one of the following acts:
a) Selling wine or beer at unsold locations as prescribed by law;
b) Open a new point of sale of alcohol or beer for local consumption within the radius of 100 m from the precincts of medical establishments, kindergartens, nursery schools, preschools and compulsory education establishments.
3. A fine of between VND 10,000,000 and 20,000,000 shall be imposed on selling wine or beer in the form of e-commerce without satisfying one of the conditions prescribed by law.
4. Additional penalties:
Suspend the license for wine or beer trading for 01 - 03 months if the violation prescribed in Point b Clause 2 or Clause 3 of this Article is committed."
Therefore, if any individual sells wine near the school premises or hospital shall be fined up to 10,000,000 VND. Concurrently, the right to use the Licenses for wine and beer trading may be deprived up to 03 months.
However, according to Clause 5 Article 4 of the Decree No. 117/2020/ND-CP:
"Article 4. Fines incurred by individuals and organizations
...
5. The fine levels specified in Chapter II of this Decree are fine levels applicable to individuals. The fine incurred by an organization is twice as much as that incurred by an individual for the same administrative violation."
Therefore, if the organization sells wine near the school or hospital will be fined up to VND 20,000,000.
