According to the provisions in the Appendix accompanying Decision 1872/QD-BTP on the amended administrative procedures related to household registration carried out at the domestic household registration agencies under the Ministry of Justice of Vietnam, detailing regulations on the procedures for marriage registration, there are 4 steps as follows:

Step 1: Preparation of documents

- Required documents to be presented:

  • Passport or ID card or Citizen Identity Card or other documents with personal photos and information issued by the competent authority, valid for verifying the identity of the person requesting marriage registration.
  • Residence confirmation document to determine jurisdiction (during the transitional period).
  • Extract of divorce note for Vietnamese citizens registering permanent residence in the commune where the marriage registration procedure takes place, who have already resolved their divorce or annulled their previous marriage at the competent authority in a foreign country.

- Required documents to be submitted:

  • Marriage registration declaration according to the provided form. Both the male and female parties can jointly fill out one marriage registration declaration.
  • Original Certificate of Marital Status issued by the People's Committee at the commune level with jurisdiction in the case where the applicant for marriage registration does not have a permanent residence registration in the commune, ward, or town where the marriage registration procedure takes place (during the transitional period).

Step 2: Submission of documents

The person requesting marriage registration submits one set of documents to the People's Committee at the commune level with jurisdiction (either the male or female party can directly submit the documents without the need for authorization from the other party).

Step 3: Processing of documents

The receiving officer is responsible for immediately checking the entire set of documents, comparing the information in the marriage registration declaration, and verifying the validity of the documents submitted by the applicant. The officer performs the following actions:

  • If the documents are complete and valid, the receiving officer writes an acknowledgment stating the date and time of result delivery.
  • If the documents are incomplete, the receiving officer guides the applicant to promptly supplement and complete the required documents according to the regulations. If it is not possible to supplement or complete the documents immediately, the receiving officer must provide written instructions specifying the type of documents and the required content for supplementation or completion, signed and clearly stating the name of the receiving officer.

Once the complete and valid documents are received, if the conditions for marriage registration are met as stipulated, the judicial officer in charge of household registration reports to the Chairman of the People's Committee at the commune level. If the Chairman of the People's Committee at the commune level approves the resolution, the judicial officer in charge of household registration records the marriage in the Marriage Registration Book.

Step 4: Receiving the result

Each spouse receives one original Marriage Certificate.

Regarding the timeframe for receiving the result:

  • On the same day of document submission;
  • If the documents cannot be processed immediately after 15:00, the result will be delivered on the next working day;
  • If it is necessary to verify the marriage conditions of both the male and female parties, the processing time should not exceed 5 working days.

Note: Both the male and female parties should verify the information in the Marriage Registration Book and Marriage Certificate. If they find the content to be correct and consistent with the marriage registration documents, the judicial officer in charge of household registration, along with the male and female parties, signs in the Marriage Registration Book and instructs them to sign on the Marriage Certificate. The Chairman of the People's Committee at the commune level organizes the delivery of the Marriage Certificate to both the male and female parties, with each party receiving one original Marriage Certificate. The number of copies of the Extract of Marriage Note is issued upon request.
