Civil aviation law is an independent branch of law in the Vietnamese legal system. The provisions of this Law create a legal basis to promote the development of Vietnam's civil aviation industry and join hands in building a healthy international aviation environment. In addition, contributing to improving the efficiency of state management of civil aviation, upholding the protection of national sovereignty and security.
The current Law on Vietnam Civil Aviation (No. 66/2006/QH11) was approved by the National Assembly in 2006 and amended in 2014 (No. 61/2014/QH13).
Subjects of application
According to Article 2 of the Law on Vietnam Civil Aviation, subjects of application of this Law are based on territory and nationality, including:
- Vietnamese organizations and individuals and foreign organizations and individuals engaged in civil aviation activities in Vietnam or civil aviation activities in the flight information region under the management of Vietnam.
- Vietnamese organizations and individuals engaged in civil aviation activities in a foreign country, unless otherwise provided for by the laws of that foreign country.
Scope of regulation
According to Clause 1 Article 1 of the Law on Vietnam Civil Aviation 2006: “This Law provides for civil aviation activities, covering aircraft, airports, airfields, aviation personnel, air navigation, air carriage, aviation security, civil liability, general aviation and other activities related to civil aviation.”
General content
- General regulations on scope of regulation, subjects of application, basic principles, state management of civil aviation and related articles.
- Regulations on aircraft: determination of nationality of aircraft, standards and issues of aircraft operation; civil rights to aircrafts; aircraft lease and lease-out; suspension of flights; detention and arrest of aircraft.
- Regulations on airports, airfields: in addition to general guiding provisions, this Law also stipulates planning, construction investment, state management and operation of airports and airfields.
- Specific regulations on aviation personnel: specifically including components, certificates of practice and principles in the work.
- Regulations on air navigation: including the management and assurance of air navigation. In addition to the prevention of risks, there are also the handlings of risks during the operation of the aircraft.
- Regulations on air carriage: including regulations on air carriage enterprises and air carriage operators. In addition, depending on the object to be transported, the provisions of this Law clearly stipulate the classification of air carriage.
Like other laws, the civil aviation law has very specific provisions on civil liability and compensation for damage. This is the basis for resolving disputes between the parties. Regulations on aviation security and some other regulations on general aviation activities.
