Resolution 102/NQ-CP: Hire a contract teacher to substitute for the teacher on maternity leave in Vietnam
Currently, the implementation of private investment in preschool and general education activities remains slow. Although the Government of Vietnam has added 20,300 preschool teacher positions to 14 provinces with high mechanical population growth and 05 Central Highlands provinces, several difficulties and issues still arise, affecting the quality of the provision of educational career services.
Therefore, to address the immediate difficulties for Ministries, sectors, and localities and ensure the implementation of the policy "where there are students, there must be teachers," "where there are patients, there must be public healthcare employees," while waiting to amend, supplement, and replace relevant legal documents, and at the same time, strictly implement Resolution 19-NQ/TW, the Government of Vietnam requires educational career units to implement the following solutions:
- Ensure a part of the regular expenses can be used to sign labor contracts with teachers within the total number of employees paid from career revenue sources assigned by competent authorities; simultaneously increase the establishment of the welfare fund sufficiently to address policies for these labor contracts when terminated;
- Ensure a part of regular expenses and public service provider education funded by the state budget to sign labor contracts (under 12 months) with teachers within the assigned number of public employee positions and following the standards of the Ministry of Education and Training to promptly replace teachers on maternity leave and retirement as per policies (who have not yet been replaced) and to arrange teachers for the second session per day (for educational institutions teaching two sessions per day).
Annually, competent authorities must organize recruitment to replace the missing number of teachers, ensuring sufficient staffing as assigned by competent authorities. Labor contracts for specialized tasks should not exceed 12 months for the position of teachers and public healthcare employees.
Additionally, for preschool and primary education in areas with particularly difficult socio-economic conditions, it is necessary to ensure sufficient teacher positions for teaching two sessions per day as regulated.
The Ministry of Education and Training must propose solutions for implementing private investment in the second session of the day for preschool and primary education, submitting to the Government of Vietnam in the third quarter of 2020.
