The summer break for teachers and students of all education levels in Vietnam is coming. What are the maternity benefits for teachers whose maternity leave coincides with the summer break?
According to the provisions at Point a Clause 2 Article 3 of Circular 48/2011/TT-BGDDT and Point a Clause 3 Article 5 of Circular 28/2009/TT-BGDDT, the summer break of teachers is considered annual leave for which they are entitled to full salary and allowances. In cases where a teacher's maternity leave coincides with the summer break, the following benefits apply:
- The teacher may take a leave before or after the maternity leave.
- The teacher may receive compensation for annual leave if there is no arrangement for annual leave different from the timing of the maternity leave as mentioned above.
The specific provisions for annual leave compensation in this case are as follows:
- Based on the financial capacity and the total number of unutilized annual leave days of the officials, the head of the agency or unit decides to support a compensation allowance for officials who have not taken annual leave or have not taken the full number of annual leave days.
- The support amount is regulated by the internal spending regulation of the agency or unit but does not exceed the amount of overtime pay for working on Saturdays and Sundays as currently stipulated.
- Payment period: Payment is to be made once a year and settled within the annual budget period according to the provisions of the Law on State Budget.
