Preschool Charter of Vietnam: Don'ts and Do’s of preschool teachers

On December 24, 2015, the Ministry of Education and Training of Vietnam issued the Consolidated document No. 04/VBHN-BGDĐT 2015 on Decision on enacting the Preschool Charter. This Document also clarifies Don’ts and Do’s of preschool teachers.

Specifically, according to Article 40 of the Preschool Charter, don’ts of teachers include:

- Harm honor, reputation, dignity or carry out physical abuse of children and colleagues;

- Defame educational contents;

- Skip classes, class sessions or cut child parenting, care and education programs at their discretion;

- Give unfair treatment to children;

- Force children to attend their extra tuitions to gain their own benefits;

- Decrease children’s meal portions; care about their individual work during class hours when they are responsible for child parenting, care and education activities.

Teachers who commit any violation against regulations set out herein shall, depending on the seriosity of such violation, be subject to disciplinary actions in accordance with laws and regulations.

Concurrently, the Preschool Charter also stipulates teacher’s duties in Article 35, including:

- Protect safety for children’s health and life during their stay at preschools, kindergartens, preschool education groups or classes.

- Perform the work of child parenting, care and education in uniformity with the early childhood education program: draw up the child care and education plan; create the educational environment, and organize child parenting, care and education activities; assess and manage children; bear responsibility for child parenting, care and education quality; participate in activities held by their specialized panels, preschools, kindergartens, independent preschool education groups or classes.

- Improve their moral standards, preserve their dignity, prestige and reputation of a teacher; act as an exemplary image, give fair treatment to children and respects for children’s personality; protect lawful rights and interests of children; foster solidarity among and provide supports for colleagues.

- Disseminate scientifically–proven parenting knowledge to parents. Proactively cooperate with children’s families to accomplish children's education aims and objectives.

- Involve themselves in physical exercise, cultural learning and professional and skill improvement activities to increase the quality of their child parenting, care and education.

- Discharge their citizen’s obligations, implement legislative regulations or sector-specific rules as well as other school regulations and decisions granted by the President.

According to this regulation, protecting safety for children’s health and life during their stay at preschools, kindergartens, preschool education groups or classes is one of the top duties of preschool teachers.

Besides, teachers also have the following rights:

- Have access to any necessary facilities to perform their child parenting, care and education activities.

- Qualify for professional level development training, professional and skill improvement, and salary, allowances and other benefits in accordance with laws when they are sent to study to improve their own professional practices and skills.

- Have access to all physical and mental rights and interests, and health care and protection policies intended for teachers.

- Have access to measures to protect their dignity and reputation.

- Exercise other rights in accordance with laws.

One of the important rights of preschool teachers is qualifying for professional level development training. According to the Preschool Charter of Vietnam, educational qualification standards for preschool teachers include two-year associate degrees in early childhood education. In order to better serve professional work, teachers are also sent to study to improve their qualifications. Besides, preschool teachers are also entitled to salary, allowances and other benefits in accordance with laws when they are sent to study to improve their own professional practices and skills.

For more information on educational qualification standards for preschool teachers, according to Point a Clause 1 Article 72 of the Education Law 2019 of Vietnam, preschool education teachers must possess at least a pedagogical college diploma. In order to solve the problem that preschool teachers do not meet the standard qualifications because they do not have a pedagogical college degree or higher, Decree No. 71/2020/NĐ-CP of Vietnam’s Government has specified a roadmap for raising the qualifications of preschool teachers from July 01, 2020. Specifically, according to Article 4 of the Decree No. 71/2020/NĐ-CP of Vietnam’s Government, the roadmap for raising the qualifications of preschool teachers is implemented from July 01, 2020 to December 31, 2030 and divided into 2 specific phases as follows:

- Phase 1: From July 01, 2020 to the end of December 31, 2025, ensure that at least 60% of preschool teachers who are being trained or have completed training programs are awarded pedagogical college diplomas;

- Phase 2: From January 01, 2026 to the end of December 31, 2030, apply to the remaining teachers to ensure 100% of preschool teachers who have completed training programs are awarded pedagogical college diplomas.
