Science and technology results are recognized through awards

Scientific and technological results recognized by competent authorities in the form of science and technology awards specified at point c, clause 2, Article 3 of Decree 13/2019/ND-CP of Vietnam include:

(1) Ho Chi Minh Prize and State Prize in Science and Technology;

(2) Ta Quang Buu Award;

(3) Tran Dai Nghia Award;

(4) Vietnam Science and Technology Innovation Award;

(5) Kovalevskaia Prize;

(6) Other awards in science and technology as prescribed in Decree 78/2014/ND-CP, as amended and supplemented by Decree 60/2019/ND-CP of Vietnam.

Scientific and technological results are certified and recognized by competent authorities

Scientific and technological results certified and recognized by competent authorities specified at Point d, Clause 2, Article 3 of Decree 13/2019/ND-CP of Vietnam include:

(1) Scientific and technological results create products licensed for production and circulation by competent authorities in Vietnam, including:

- Plant varieties, fertilizers, veterinary drugs, and plant protection drugs produced in Vietnam are granted the Decision on recognition of circulation of plant varieties, Decision on recognition of fertilizers in circulation, Certificate of circulation of veterinary drugs, Certificate of registration of pesticides in Vietnam;

- Medicines and medicinal ingredients, and medical equipment manufactured in Vietnam are granted a certificate of circulation in Vietnam;

- Biological products in the field of environment produced in Vietnam are granted the Certificate of circulation in Vietnam.

(2) Results of performing scientific and technological tasks funded by the state budget are granted decisions by competent state agencies on recognition of results of scientific and technological tasks funded with the state budget or Certificate of registration of results of performing scientific and technological tasks funded with the state budget.

(3) Results of performing scientific and technological tasks without the use of the state budget are granted certificates by competent state agencies or certificates of appraisal of results of performing scientific and technological tasks without using the state budget.

(4) Other scientific and technological results obtained by ministries, ministerial-level agencies according to branches and domains under their management or People's Committees of provinces and centrally-run cities of Vietnam (where scientific and technological results are located) technology transferred, applied) recognized, certified in accordance with the law.

If it is necessary to determine the scientific and technological results according to the above provisions, the specialized agency in charge of science and technology under the People's Committee of the province or city of Vietnam directly under the Central Government shall send a written request to the Department of Market Development and Industry to support.

The result of science and technology is the technology that is transferred from abroad to Vietnam

According to Article 5 of Circular 10/2021/TT-BKHCN of Vietnam, the determination of science and technology results as technologies transferred from abroad to Vietnam must meet the following criteria:

- Having a certificate of registration of technology transfer;

- Belonging to the List of technologies encouraged to be transferred as prescribed in Clause 4, Article 39 of the Law on Technology Transfer of Vietnam and Appendix I of Decree 76/2018/ND-CP.

Enterprises receiving technology transfers from abroad into Vietnam have the ability to apply the transferred science and technology results (detailed in Section 6, form No. 02 of Decree 13/2019/ND-CP).

Circular 10/2021/TT-BKHCN of Vietnam takes effect from January 20, 2022.
