Article 24 of Circular 46/2014/TT-BTC specifically regulates the handling of violations related to candidates taking the valuer exam in Vietnam as follows:
1. The violations committed by candidates will be specified in the exam rules and regulations for each exam by the Chairman of the Examination Council.
2. Candidates committing violations against the exam rules must have a record of the violation made by the exam invigilator, signed by both the invigilator and the candidate. After making the record and announcing it publicly in the exam room, the invigilator must immediately report to the head of the exam venue. If the candidate deliberately refuses to sign the record, the record with the invigilator's signature still holds legal value.
3. Reprimand: The disciplinary measure of reprimand is made in a record by the exam invigilator and announced publicly in the exam room. Candidates reprimanded in any exam will have 1/4 (25%) of their exam score deducted for that exam.
4. Warning: The disciplinary measure of warning is made in a record by the exam invigilator, seizing any evidence (if any), specifying the form of disciplinary action in the record, and announcing it publicly in the exam room. Candidates receiving a warning in any exam will have 1/2 (50%) of their exam score deducted for that exam.
5. Disqualification from the exam: The disciplinary measure of disqualification from the exam is made in a record by the invigilator, seizing any evidence (if any), and reporting to the head of the exam venue for a decision and public announcement in the exam room. Candidates disqualified in any exam will have their exams graded (0).
Disqualified candidates must leave the exam room immediately after the announcement of the decision by the head of the exam venue; they must submit the paper and any work done.
Disqualified candidates are allowed to continue taking the remaining registered papers, and the completed papers will be marked and preserved according to regulations.
6. Cancellation of exam results
The Chairman of the Examination Council shall consider and decide on the cancellation of exam results based on the recommendations of the exam invigilator and the head of the exam venue. Candidates whose exam results are canceled will be barred from taking the exam for the next two examination periods or, depending on the severity of the violation, recommended for criminal prosecution by competent authorities according to the law. The cancellation of exam results applies to candidates involved in the following actions:
- Engaging in physical altercations or threatening responsible officials during the exam or threatening other candidates;
- Disrupting the order and security of the exam venue, causing severe consequences for the exam;
- Falsifying exam records, taking the exam on behalf of others, or asking others to take the exam on their behalf.
7. Candidates have the right to report any violations of exam rules to the invigilator, the head of the exam venue, or the Examination Council.
