Vietnam: Erasing the land surveying and mapping practicing certificate shall be fined up to VND 10 million

Recently, the Government of Vietnam issued Decree No. 18/2020/ND-CP on penalties for administrative violations against regulations on land surveying and mapping.

According to Clause 1 Article 5 of Decree No. 18/2020/ND-CP of Vietnam’s Government, a fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for “falsifying the land surveying and mapping practicing certificate”; concurrently, confiscating the exhibit or instrumentality used for committing this violation.

This penalty also applies to the act of “practicing land surveying and mapping against the practicing certificate”.

Moreover, Decree No. 18/2020/ND-CP also specifies penalties for acts relating to conditions for provision of land surveying and mapping services, specifically as follows:

- A fine ranging from VND 10,000,000 to VND 20,000,000 shall be imposed for any one of the following violations:

+ Falsifying the application for issuance of the land surveying and mapping license;

+ Practicing land surveying and mapping without the practicing certificate or during the license suspension period;

+ Carrying out land surveying and mapping activities without maintaining the fulfillment of prescribed conditions for issuance of the land surveying and mapping license.

- A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for any one of the following violations:

+ Carrying out land surveying and mapping activities against the land surveying and mapping license;

+ Falsifying the land surveying and mapping license;

+ Carrying out land surveying and mapping activities with an unexpired land surveying and mapping license.

- A fine ranging from VND 40,000,000 to VND 50,000,000 shall be imposed for carrying out land surveying and mapping activities without the license or carrying out land surveying and mapping activities during the license suspension period.

Administrative violations mentioned above are also subject to corresponding additional penalties and remedial measures.
