This is a new notable content of Decree No. 18/2020/ND-CP of Vietnam’s Government on penalties for administrative violations against regulations on land surveying and mapping, which replaces Decree No. 173/2013/ND-CP.
According to Decree No. 18/2020/ND-CP of Vietnam’s Government, the act of obstructing legal land surveying and mapping activities carried out by entities is an administrative violation and will be sanctioned.
Specifically, according to Article 12 of Decree No. 18/2020/ND-CP:
Article 12. Act of obstructing legal land surveying and mapping activities carried out by entities
1. A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed for obstructing an entity in the use of the survey marker when carrying out land surveying and mapping activities.
2. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for obstructing the legal land surveying and mapping activities carried out by an entity.
Thus, from April 01, 2020, if an individual or organization commits one of the two obstructive acts mentioned above, they will be fined up to VND 10 million. This is a new penalty provision supplemented in Decree No. 18/2020/ND-CP, as the current Decree No. 173/2013/ND-CP amended by Decree No. 84/2017/ND-CP does not address these violations.
Moreover, this is also one of the two violation behaviors stated in Decree No. 18/2020/ND-CP that is subject to only a monetary fine without any additional penalty or remedial measures. However, the maximum fine of VND 10 million demonstrates the strictness of the law in dealing with individuals and organizations involved in such violations.
