Vietnam: Authority to impose penalties for administrative violations against regulations on animal feeds and aqua feeds

According to Decree No. 64/2018/ND-CP of Vietnam’s Government, entities that have the power to impose penalties for administrative violations include: Chairpersons of People’s Committees at all levels, inspectors, People’s Public Securities forces, border guard forces, marine police forces, customs agencies, market surveillance units.

The delineation of power to impose penalties for administrative violations and application of additional penalties and remedial measures of the above-mentioned entities are prescribed as follows:

- Chairpersons of People’s Committees at all levels shall have the authority to handle violations specified in Article 27 of Decree No. 64/2018/ND-CP and exercise the assigned functions, tasks, and powers.

- Persons of Inspectorate agencies empowered to impose penalties for administrative violations shall have the authority to handle violations specified in Article 28 of Decree No. 64/2018/ND-CP and exercise the assigned functions, tasks, and powers.

- Persons of People’s Public Securities forces empowered to impose penalties for administrative violations shall have the authority to handle violations specified in Article 29 of Decree No. 64/2018/ND-CP and exercise the assigned functions, tasks, and powers.

- Persons of customs agencies empowered to impose penalties for administrative violations shall have the authority to handle administrative violations against regulations on livestock breeds, animal feeds and aqua feeds specified in Clause 8 Article 10, Clause 2 Article 21 of Decree No. 64/2018/ND-CP and exercise the assigned functions, tasks, and powers.

- Persons of market surveillance units empowered to impose penalties for administrative violations shall have the authority to impose penalties for administrative violations and apply additional penalties and remedial measures to administrative violations against regulations on livestock breeds, animal feeds and aqua feeds specified in Article 8, Clause 2 Article 9, Clause 8 Article 10, Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 Article 11, Article 17, Article 21 of Decree No. 64/2018/ND-CP and exercise the assigned functions, tasks, and powers.

- Persons of border guard forces and marine police forces who are empowered to impose penalties for administrative violations shall have the authority to impose penalties for administrative violations and apply additional penalties and remedial measures to administrative violations against regulations on livestock breeds, animal feeds and aqua feeds specified in Clause 8 Article 10, Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 Article 11, Article 21 of Decree No. 64/2018/ND-CP and exercise the assigned functions, tasks, and powers.

Decree No. 64/2018/ND-CP of Vietnam’s Government takes effect from June 22, 2018.
