To complete regulations on signing and implementing electronic contracts in Vietnam (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On January 9, 2024, the Government issued Resolution 11/NQ-CP on the Government Conference with localities and the regular Government Meeting in December 2023.

To complete regulations on signing and implementing electronic contracts in Vietnam

Specifically, the Government basically agrees with the main contents of the 2023 National Digital Transformation Report presented by the Ministry of Information and Communications in document 182/BC-BTTTT dated December 29, 2023.

At the same time, relevant agencies are requested to implement the following key contents:

(1) The Ministry of Information and Communications presides over and coordinates with the Government Office to develop and submit to the Prime Minister for promulgation the Work Plan of the National Committee on Digital Transformation in 2024, completed in January. 2024.

(2) Ministries, agencies, and localities:

- Urgently carry out assigned tasks in the National Digital Transformation Program, E-Government Development Strategy towards Digital Government, National strategy for developing the digital economy and digital society for the period 2021–2025, with an orientation to 2030; focus on promoting the building and improvement of institutions and policy mechanisms for national digital transformation; focus on training, recruiting, arranging, and remunerating human resources for digital transformation, especially high-quality human resources.

- Develop an overall and comprehensive digital economy, focusing on 04 main priority areas: information and communication technology industry, the digitalization of economic sectors associated with increasing social labor productivity and innovation, digital management, and digital data development.

- Effectively deploy digital platforms, digital applications, digital services, promote the development of artificial intelligence platforms, VNeID digital citizen applications, digital payments, electronic invoices, electronic contracts, personal digital signatures, etc.

- Review and evaluate the information security and network security of information systems and databases; urgently overcome limitations and inadequacies in security holes, information leaks, and personal data protection.

- Universalize digital infrastructure and create digital applications to develop the digital economy; promote the construction, development, and connection of digital platforms, national databases, and specialized databases to integrate and share data information to serve the direction and administration of the Government, the Prime minister, and authorities at all levels; resolve administrative procedures for people and businesses; and connect and share data with the Center for Information and executive direction of the Government and the Prime Minister.

- Complete regulations on signing and implementing electronic contracts, such as electronic signatures, digital signatures, and reliable services to deploy and apply in accordance with the practical conditions of the industry and management field. Connect and integrate the information system for handling administrative procedures at ministerial and provincial levels with the public digital signature authentication service connection portal. Increase the use of digital signatures in the direction, administration, and implementation of public administrative services and transactions in the electronic environment.

To implement inspections according to the 2024 plan to ensure they are on schedule

The Government basically agrees with the main results of inspection work, citizen reception, resolving complaints and denunciations, preventing and combating corruption and negativity in 2023, and main directions and tasks in 2024 submitted by the Government Inspectorate in document No. 3129/BC-TTCP dated December 27, 2023.

In addition, ministries, agencies, and localities are also required to:

- Fully implement the 2024 Working Program of the Central Steering Committee on preventing and combating corruption and negativity; 05 groups of tasks and solutions stated in Resolution 168/NQ-CP in 2023 on the National Strategy for preventing and combating corruption and negativity until 2030.

Strictly implement the regulations of the Inspection Law 2022; deploy inspections according to the 2024 plan; and assign unscheduled inspections to ensure quality and on schedule.

- Synchronously implement solutions according to Resolutions and directions of the Politburo, National Assembly, Government, and Prime Minister on strengthening the Party's leadership in citizen reception and resolving complaints and denunciations; Completely resolve crowded, complicated, and prolonged complaints and denunciations, avoiding "hot spots"; Seriously carry out the responsibility to participate in court hearings, dialogue, and execute the Court's judgments according to the provisions of the Law on Administrative Procedure for cases initiated by citizens.
