As we know, Tet is a day for family reunions. It is typical for relatives and friends to gather and drink together during Tet. The issue that arises is whether people can participate in traffic after consuming alcohol. Additionally, how much alcohol can be consumed before one is penalized for driving?
For car drivers:
According to the instructions in Point a Clause 6, Point b Clause 8, Point a Clause 9, and Point d Clause 12 Article 5 of Decree 46/2016/ND-CP:
If driving on the road with a blood alcohol concentration (BAC) or breath alcohol concentration not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/liter of breath, a fine ranging from 2,000,000 VND to 3,000,000 VND will be imposed.
If the BAC ranges from 50 to 80 milligrams/100 milliliters of blood (or over 0.25 - 0.4 milligrams/liter of breath), the driver will be fined 7,000,000 - 8,000,000 VND, and the driver's license will be suspended for 3 - 5 months.
Particularly, if the driver has a BAC exceeding 80 milligrams/100 milliliters of blood (or higher than 0.4 milligrams/liter of breath), a fine of 16,000,000 - 18,000,000 VND will be imposed, and the driver's license will be revoked for 4 - 6 months.
For motorcycle drivers:
According to the regulations in Clause 6, Point c Clause 8, Point b, d Clause 12 Article 6 of Decree 46/2016/ND-CP:
Motorcycle drivers will be fined from 1,000,000 VND to 2,000,000 VND if the BAC exceeds 50 milligrams to 80 milligrams/100 milliliters of blood (or exceeds 0.25 milligrams to 0.4 milligrams/liter of breath), with an additional penalty of license suspension from 1 to 3 months.
A fine ranging from 3,000,000 VND to 4,000,000 VND will be imposed on those driving on the road with a BAC exceeding 80 milligrams/100 milliliters of blood (or exceeding 0.4 milligrams/liter of breath), and the driver's license will be revoked for 3 to 5 months.
According to the standards set by the World Health Organization (WHO), one standard drink contains 10 grams of alcohol. This corresponds to one shot of spirits (40 degrees, 30 ml); one glass of wine (13.5 degrees, 100 ml); one pint of draft beer (330 ml); or 2/3 of a bottle (can) of beer (330 ml).
Therefore, it is advised that everyone should only drink from one to one and a half cans of beer before driving to avoid fines. However, the BAC/breath alcohol concentration also depends on each individual's health and physical condition. To ensure safety while driving and not violate traffic laws, each person should consider their alcohol consumption during the Tet holiday. Ideally, it is best to minimize alcohol consumption when participating in traffic. This not only complies with the law but also protects one's life and the lives of others.
