Regarding this issue, LawNet would like to answer as follows:

On November 6, 2023, the Ministry of Home Affairs issued Official Dispatch 6463/BNV-TCPCP on the establishment of the Elderly Association in localities meeting the conditions.

Specifically, based on the policies of the Secretariat in Conclusion 58-KL/TW dated June 23, 2023 on the organization and activities of the Vietnam Association of the Elderly and Decision 118-QD/TW dated August 22, 2023 promulgating the Regulations on organization and operation of mass associations assigned tasks by the Party and State at the Central level, directed by Deputy Prime Minister, Chairman of the National Committee for the Elderly of Vietnam Tran Hong Ha, the Ministry of Home Affairs agreed with the Vietnam Association of the Elderly and relevant agencies to give their opinions regarding the establishment of the Provincial and District Elderly Association as follows:

(1) Pursuant to the Charter of the Vietnam Association of the Elderly, the Provincial Association of the Elderly Representative Board proactively coordinates with relevant agencies to develop a report requesting policy from the Standing Committee of the Provincial Party Committee and City Party Committee (hereinafter referred to as the competent level) on the establishment of the Provincial and District Elderly Association in places with sufficient conditions.

(2) After the competent authority has agreed to establish an Association, the Provincial and District Representative Board performs the tasks of the Campaign Board (hereinafter referred to as the Representative Board) and completes the documents to establish the Association and reports to the Chairman of the Provincial People's Committee or Chairman of the District People's Committee (if authorized), consider establishing an Association according to authority; At the same time, propose a plan to transfer the rights and obligations, assets, finances, employees, and payroll (if any) of the Representative Board to the Association when established; The Representative Board will terminate its operations according to regulations after completing the transfer.

Pursuant to the Decision to establish the Association, the Representative Board coordinates with relevant agencies to prepare for the Congress and report to competent authorities; organizes a Congress to elect the Executive Committee and Inspection Committee; approves the Resolution to agree to use the Charter of the Vietnam Elderly Association approved by the Ministry of Home Affairs; and other contents of the Congress.

(3) For 13 provinces and cities that have piloted the Provincial and District Elderly Association model: in cases where there has been a Decision to establish the Provincial and District Elderly Association according to regulations, they will continue to operate. In case there is no Decision to establish the Provincial or District Elderly Association, establish the association according to (1), (2).

(4) The Vietnam Association of the Elderly is responsible for proactively coordinating with relevant agencies to guide the Representative Board to report on policies and establish the Association according to the regulations and Charter of the Vietnam Association of the Elderly.

(5) People's Committees of provinces and centrally run cities pay attention and create conditions for establishing the Provincial and District Elderly Associations according to the authority and policies of the Secretariat in Conclusion 58-KL/TW, Decision 118-QD/TW, and actual local conditions; direct the assignment of Departments and branches to participate in coordinating and advising the Standing Committee of the Provincial Party Committee and City Party Committee to implement Decision 118-QD/TW on directing, specifying, and arranging tasks to be assigned to mass associations in accordance with local conditions and task requirements.

Tasks and powers of the Vietnam Association of the Elderly in Vietnam

Specifically, Article 7 and Article 8 of the Charter issued together with Decision 972/QD-BNV in 2017 stipulate the tasks and powers of the Vietnam Association of the Elderly as follows:

* Tasks

- Carry out tasks specified in Article 27 of the Law on the Elderly, including:

+ Gather, unite, and encourage the elderly to participate in the activities of the Association of the Elderly, contributing to the implementation of economic - cultural - social programs; educate the young generation; build a civilized lifestyle; create cultured families; maintain political security, social order, and safety; and build and protect the Fatherland;

+ Be the core of the movement of all people to care for, support, and promote the role of the elderly;

+ Protect the legitimate rights and interests of elderly members;

+ Research the legitimate needs and aspirations of the elderly to make recommendations to competent state agencies;

+ Representing Vietnamese elderly people to participate in international organizations and people-to-people diplomacy activities for the benefit of the Fatherland and the elderly.

- Participate in building and protecting social order and safety; participate in organizing the month of action for the elderly in Vietnam.

- Perform other tasks as prescribed by law.

* Power

- Participate with the Party and State in building mechanisms and policies directly related to the elderly and implementing the Constitution and Law on the Elderly.

- Participate in implementing a number of activities and services in the Association's field of activities according to the provisions of law.

- Consult and monitor policies, programs, topics, and projects requested by state agencies on issues in the field of the elderly and the Association's activities according to the provisions of the Association's Charter and provisions of law.
