Charter of Kindergartens

Nursery schools, kindergartens (collectively referred to as schools), daycare centers, childcare groups, and independent kindergarten classes are organized in the following forms: public, semi-public, and private. To be specific:

- Public schools, daycare centers, childcare groups, and kindergarten classes are established by State agencies, which invest in building facilities and ensure funding for regular expenditure.- Semi-public schools, daycare centers, childcare groups, and kindergarten classes are established by local communities, which invest in building facilities, ensure operational funding, and receive local government support.- Private schools, daycare centers, childcare groups, and kindergarten classes are established by social organizations, socio-professional organizations, economic organizations, or individuals, which invest in building facilities and ensure operational funding from non-state budget sources.

The decentralization of management is implemented as follows:

- People's Committees at the district level (including urban districts, rural districts, district-level towns, and provincial cities) perform state management functions regarding education for schools and daycare centers.- People's Committees at the commune level (including communes, wards, and commune-level towns) perform state management functions regarding education for independent childcare groups and independent kindergarten classes.

Conditions for Establishment of Schools and Daycare Centers

Schools and daycare centers can be established when they meet the following conditions:

- There is a proposal for establishment that aligns with the socio-economic development plan and the approved local educational network plan;- The proposal for establishment clearly defines the goals, tasks, education programs, and content; land, facilities, equipment, and the proposed location for building the school; organizational structure, resources, and finance; strategic directions for construction and development of the school or daycare center.

Schools and daycare centers are permitted to operate educational activities when they meet the following conditions:

- A decision on establishment or permission for establishment;- Land, campus, facilities, and equipment as stipulated in Chapter IV of this Charter, ensuring the requirements for maintaining and developing educational activities;- The location ensures an educational environment and safety for learners, teachers, and staff;- At least three childcare groups or kindergarten classes are present, with a minimum of 50 children and no more than 20 groups or classes;- Possession of preschool education programs and materials for child care and education as regulated by the Ministry of Education and Training;- A team of qualified and sufficient teachers and managers, reasonably structured to implement preschool education programs and organize educational activities as stipulated in Articles 22 and 24 of this Charter;- Sufficient financial resources as prescribed to ensure the maintenance and development of educational activities;- Possession of the organizational and operational regulations for the school or daycare center.

Maximum of 25 Children in a Kindergarten Class for Age 3-4

Children are grouped into childcare groups or kindergarten classes. Children from 3 months to 36 months old are grouped into childcare groups. The maximum number of children in a group is as follows:

- Group from 3 to 12 months old: 15 children;- Group from 13 to 24 months old: 20 children;- Group from 25 to 36 months old: 25 children.

Children from three to six years old are grouped into kindergarten classes. The maximum number of children in a kindergarten class is as follows:

- Kindergarten class for 3-4 years old: 25 children;- Kindergarten class for 4-5 years old: 30 children;- Kindergarten class for 5-6 years old: 35 children.

If the number of children in each group or class is less than 50% of the maximum number, it can be organized into mixed groups or classes, with no more than 2 children with the same type of disability in each group or class.

Prohibition of Teachers from Harming Children and Reducing Their Meals

According to the Charter, preschool teachers must have a graduation certificate from a preschool teacher training program; school healthcare staff and accountants must have a graduation certificate relevant to their assigned specialization; treasurers, librarians, clerks, cooks, and security personnel must be trained in their assigned professions.

Teachers are prohibited from:

- Insulting the honor and dignity, or infringing on the physical integrity of children and colleagues;- Distorting educational content;- Skipping classes or lessons; arbitrarily cutting educational programs for nurturing and care;- Treating children unfairly;- Forcing children to take extra classes to collect fees;- Reducing children’s meal portions; engaging in personal tasks while organizing nurturing, care, and educational activities for children.
