Survey Procedure for Asset Valuation in Criminal Proceedings

Recently, the Ministry of Finance issued Circular 43/2018/TT-BTC replacing Circular 55/2006/TT-BTC which provides guidance on Decree 30/2018/ND-CP stipulating the detailed regulations on the establishment and operation of the Asset Valuation Council; the procedures for asset valuation in criminal proceedings.

According to Circular 43, the market price survey based on the wholesale and retail prices of assets to be valued or similar assets in Criminal Procedure shall be conducted as follows:

- Develop survey content:- Determine the legal characteristics, key economic and technical characteristics of the assets to be valued; determine the condition to be valued...- Determine the location where the assets are requested for valuation;- Determine the time when the assets are requested for valuation and the time of conducting the price survey;- Determine the method of price survey: directly in the official or unofficial market; on electronic information pages via the Internet...- Conduct price surveys, collect price levels of assets:- Conduct price surveys according to the determined contents.- The survey and collection of price levels must be conducted with at least 03 survey forms for each asset requested for valuation.- The collection of price levels must comply with the provisions in Clause 4 Article 3 of Circular 43.- Based on the information collected, aggregate the collected data, and prepare a report to the Asset Valuation Council.
