Responsibility for Establishing Procedures for Roadwork Maintenance

Circular 37/2018/TT-BGTVT issued by the Ministry of Transport on June 7, 2018, specifically stipulates the responsibility for establishing the road maintenance process as follows:

For new construction investment projects, renovation, and upgrading of transportation infrastructure, the following entities are responsible:

- The technical design contractor (for projects requiring a 3-step design process) and the construction drawing design contractor (for projects requiring a 1 or 2-step design process) are responsible for preparing and handing over the maintenance procedures for the works or parts of the works designed by them along with the design documentation to the investor. They must update the maintenance procedures to match any design changes during the construction process if applicable, before the acceptance of the project or part of the project for use;- The contractor supplying equipment to be installed in the project (including payment stations for vehicles using toll roads in business road construction projects, vehicle weight check stations, traffic management and monitoring systems, and other equipment installations) is responsible for handing over the maintenance procedures for the equipment supplied by them to the investor before installation in the project;- In cases where the design contractor or equipment supplier specified in points a and b of this clause fail to prepare the maintenance procedures, the investor shall hire a consulting organization with the required legal capacity to prepare the maintenance procedures and shall be responsible for covering the consulting costs.

Note, for existing projects that lack maintenance procedures, the owner or the manager, and user of the project are responsible for organizing the preparation of road maintenance procedures.However, it is not obligatory to prepare separate maintenance procedures for each road project of grade III or lower, or for temporary projects. The owner or the manager and user of the project must still perform road maintenance as specified in this Circular and under legal regulations concerning the quality management and maintenance of construction projects.

If there are technical standards for maintenance or applicable maintenance procedures for similar projects, the owner or the manager and user of the project can apply those technical standards or procedures to their project without needing to prepare separate procedures.
