Responsibilities of State Agencies in Codification Work

According to the provisions of Article 15 of the Ordinance on Codification of the Legal System 2012, the responsibilities of state agencies in codification work and ensuring funding for codification work are as follows:

- Responsibilities of the Ministry of Justice:

- Submit to the competent authority or issue according to its authority legal documents on codification;- Guide the implementation of codification; train and foster professional skills for officials involved in codification work;- Inspect and supervise codification implementation by the codification executing agencies;- Handle within its authority or submit to the Government of Vietnam, the Prime Minister of the Government of Vietnam to handle issues related to the implementation of codification;- Develop a Scheme for the construction of the Code to submit to the Prime Minister of the Government of Vietnam for approval;- Develop the Codification Information Portal; regularly maintain the Code on the Codification Information Portal; manage and issue regulations on mobilizing social resources in the publication of the Code in written form;- Annually report to the Government of Vietnam on codification work.

- Responsibilities of the codification executing agency:

- Execute codification according to the topics assigned by the Prime Minister of the Government of Vietnam;- Ensure the accuracy and completeness of lawful provisions codified within the topic;- Timely propose and execute the codification of new legal provisions, new topics;- Ensure the conditions for codification execution.

The funding for codification work is provided by the state budget and includes:

- Funding for codification execution, appraisal, updating new legal provisions, updating new topics, managing, and maintaining the Code are arranged in the annual budget estimates of executing agencies;- Funding for constructing the Code is provided according to the Scheme for constructing the Code.

The Ministry of Finance shall preside and cooperate with the Ministry of Justice to specify the use of funds for codification work.
