Regulations on Codification by Title

Ordinance on Compilation of the Legal Normative System 2012 was promulgated on April 16, 2012. One of the basic contents stipulated in this document is the provision on compilation by subject.

To be specific, according to the provisions of Article 9 of the Ordinance on Codification of the Legal Normative Documents System 2012, the codification by topic is conducted as follows:

  1. Construct the structure of the topic based on the structure of the legal normative documents with the highest legal effect regulating the group of social relations within the content of the topic; if necessary, the codification agency may add parts, chapters, and sections into the structure of the topic.

  2. Collect and classify legal normative documents belonging to the content of the topic; review to eliminate contents that do not contain legal norms or are no longer effective; identify conflicting, overlapping, or no longer suitable legal norms to handle according to authority.

  3. Gather the remaining effective legal norms and arrange them in the order of the legal effect of the documents containing the legal norms being codified from high to low; detailed regulations and implementation guidelines are arranged immediately after the legal norms they detail or guide.

The codification agency recommends that state authorities handle conflicting, overlapping, or no longer suitable legal norms.
