Receiving Dossiers for Issuance, Renewal, Reissuance of Licenses and Certificates for Weapons, Explosives

Recently, the Ministry of Public Security issued Circular 50/2014/TT-BCA regulating the issuance, renewal, and re-issuance of licenses and certificates concerning weapons, explosives, and supporting tools.

According to Article 7 of Circular 50/2014/TT-BCA, an officer assigned to receive applications for resolving procedures related to the issuance, renewal, and reissuance of licenses and certificates of weapons, explosives, and supporting tools must review the dossiers, compare them with the legal regulations on the management and use of weapons, explosives, and supporting tools, and carry out the following:

1. In cases where the application meets the conditions and procedures (valid application):

- Record the received applications in the logbook;- Prepare and return an appointment letter and a receipt to the applicant with the following details: name, title, working unit of the receiving officer; documents and materials in the application; the time for returning the results, and sign and write clearly the name.

2. In cases where the application meets the conditions but lacks procedures or is inaccurately declared, provide written guidance specifying the procedures and contents that need to be supplemented or re-declared. After the agency, organization, unit, or individual completes the application according to the instructions, the receiving officer shall carry out according to the provisions in Clause 1 of this Article.

3. In cases where the application does not meet the conditions, do not accept it and respond in writing, clearly stating the reason for not accepting it, and notify the agency, organization, unit, or individual that made the request.

4. The officer, upon receiving the valid application, must report and transfer it to the department-level leader (if the application is submitted to the Department of Administrative Management on Social Order), or the team leader (if the application is submitted to the Provincial Police Department of Administrative Management on Social Order) for assignment to an officer to review and check the application as per regulations.

Note: For applications requesting the issuance of a certificate for the declaration of rudimentary weapons, the officer, upon receiving the application, must report and transfer it to the Chief of the Commune Police.
