Provincial Fire Prevention and Fighting Police Department Must Receive Dossiers and Propose Administrative Sanctions for Fire and Explosion Incidents

This is one of the duties of the Fire Prevention, Fighting and Rescue Police Department under the Provincial Police, as stipulated in Circular 39/2015/TT-BCA on the assignment of responsibilities and coordination relationships in the investigation and resolution of fire and explosion incidents by the People's Public Security forces.

Circular 39/2015/TT-BCA prescribes the responsibilities of the Fire Prevention, Firefighting and Rescue Department under the Provincial Police in the investigation and resolution of fire and explosion incidents, including:

- Taking the lead in handling and resolving from the beginning for fire incidents under the following circumstances: No fatalities; one person injured; no foreign elements; fire area under 500 m² or estimated damage under 3 billion VND (based on initial statistics).

When resolving fire incidents, if criminal signs within initial investigation jurisdiction are detected, some investigative activities should be conducted per the legal provisions on criminal investigations.

For fire incidents with other criminal signs beyond the initial investigation jurisdiction, transfer the case file immediately to the competent Investigation Agency under the statutory provisions on criminal procedure and criminal investigation organization.

- Coordinate with the Investigation Agency; the higher-level Fire Prevention, Firefighting and Rescue Agency to conduct scene examinations and other investigative activities as required when they lead the investigation of fire and explosion incidents.

- Receive files, evidence, means, and propose administrative penalties for fire and explosion incidents without criminal signs but with administrative violation signs transferred by the Investigation Agency for sanctioning under authority.
