Procedures for replacement of driving licenses issued by the police security in Vietnam

(1) Implementation Steps:

* Submit administrative procedure dossier:

- The driver prepares an application and sends it to the Department of Transportation in Vietnam.

* Process administrative procedure dossier:

- The Department of Transportation in Vietnam checks the application upon receipt; if the application does not comply with regulations, it must notify directly or in writing the contents that need to be supplemented or amended to the individual within 02 working days from the date of receipt of the application;

- In case of suspicion, the Department of Transportation in Vietnam sends a written request to the Traffic police security of the Ministry of Public Security or the Department of Transportation in Vietnam managing drivers' licenses for verification;

- The individual who submits the application directly is responsible for fulfilling the obligation of paying the driving license issuance fee upon receipt of the application as prescribed;

- When performing the procedure to replace the driving license, the driver must take a photo directly at the Department of Transportation in Vietnam and present the original documents for comparison (except for the originals already submitted);

- Within 05 working days from the date of receiving all properly submitted documents, the Department of Transportation in Vietnam replaces the driving license; if the license is not replaced, it must provide an explanation and state the reason;

- The Department of Transportation in Vietnam retains copies of the driving license replacement application or the driving license issued by the police security for 02 years from the date of issuance. The old driving license is corner-cut and handed over to the driver for safekeeping;

(2) Method of submitting the application: In person.

(3) Components and number of applications:

(3.1) Application includes:

* Application for replacement of motorbike driving license issued before August 01, 1995 by the public security:

- An application for replacement of the driving license, using Form prescribed in Appendix 19 enclosed herewith;

- Original documents (if any);

* Application for replacement of driving license issued from August 01, 1995 by the public security:

- An application for replacement of the driving license, using Form prescribed in Appendix 19 enclosed herewith;

- Copy of driving license; copy of Decision on retirement or discharge issued by competent authority or copy of Decision on discontinuation of working in the commune police force issued by the competent authority or copies of Decision to terminate the labor contract and decision on recruitment or labor contracts with a term of at least 12 months of units under the public security;

- Health certificate issued by the competent medical facility as prescribed, except for replacement of A1, A2 or A3 class driving license;

* Application for replacement of driving license issued by the public security to a civil learner of a People's Public Security school before July 31, 2020:

- An application for replacement of the driving license;

- Health certificate issued by the competent medical facility as prescribed, except for replacement of A1, A2 or A3 class driving license;

- A copy of Decision acknowledging graduation issued by the School or Academy in the People's Public Security;

- Original documents issued by the public security, including applications for driving test, issuance and replacement of driving license certified by the head of unit for which he/she is working; health certificate of the driver; certificate of graduation from the driving training course; and record of consolidated results of driving test;

(3.2) Number of applications: 01 set.

(4) Time limit for settlement:

- Within 05 working days from the date of receiving all properly submitted documents.

(5) Entities carrying out administrative procedures: Individuals.

(6) Agency carrying out administrative procedures:

- The authorized agency for resolution: Department of Transportation in Vietnam;

- Authorized or decentralized agency or person: None;

- Agency directly implementing the administrative procedure: Department of Transportation in Vietnam;

- Coordinating agency: None.

(7) Result of carrying out administrative procedures:

- Road motor vehicle driving license.

(8) Fees and Charges:

- Fee for the issuance of a driving license: 135,000 VND per time.

(9) Name of application forms and administrative declaration forms; Sample results of carrying out administrative procedures:

- Application form for replacing (reissuing) a driving license;

- Road motor vehicle driving license.

(10) Requirements and conditions for carrying out administrative procedures:

- Individuals with driving licenses issued by the police security after July 31, 1995, still valid, when no longer serving in the Police (retired, transferred sector, ceased labor contract within the People's Police), if needed, can apply for replacing a driving license;

- Individuals with motorcycle driving licenses issued by the police security before August 1, 1995, damaged, wishing to replace, having their names recorded in the register, can apply for a new driving license.
