Procedure for Announcing Administrative Inspection Decisions in the People's Public Security Forces

Recently, the Ministry of Public Security issued Circular 02/2015/TT-BCA stipulating the procedures for conducting an administrative inspection within the People's Public Security force.

According to Circular 02/2015/TT-BCA, within 15 days from the date of issuing the inspection decision, the head of the inspection team is responsible for publishing the inspection decision. The announcement of the inspection decision must have representatives from the leading agency in charge of the inspection, the Inspection Team, heads of the public security unit, locality, and individuals subject to inspection. If necessary, the head of the inspection team may invite representatives from relevant agencies, organizations, and individuals to attend the announcement of the inspection decision.

The process of publishing the administrative inspection decision in the People's Public Security is carried out as follows:

- The head of the inspection team announces the entire inspection decision and communicates related contents; clearly states the purpose, requirements, content, and duration of the inspection; duties and powers of the Inspection Team; rights and responsibilities of the subject of inspection; the working plan of the Inspection Team; the working relationship between the Inspection Team and the subject of inspection; and other contents related to the activities of the Inspection Team;

- Representatives of the subject of inspection directly report on the inspection contents as per the requested outline. The head of the inspection team may request the subject of inspection to continue supplementing and completing the report to send to the inspection team;

- The publication of the inspection decision must be documented in a written record, including the signatures of the head of the inspection team and representatives of the subject of inspection.

The publication of the inspection decision is carried out at the head office of the unit directly subject to inspection. In case it is necessary to publish the inspection decision at another location, the head of the inspection team is responsible for reporting to the decision-maker for consideration and decision. Based on the instructions of the decision-maker, the head of the inspection team shall notify the head of the public security unit, locality, individuals subject to inspection, and the unit where the Inspection Team publishes the inspection decision.
