Market Inspectors: Relevant Regulations

Circular 09/2018/TT-BCT stipulates professional standards and qualifications for Market Management officers, issued on May 23, 2018. Specific regulations regarding market inspectors are as follows:

1. Responsibilities

Supervise the professional expertise and basic tasks of the Market Management force, assist the Heads of Market Management agencies at all levels in carrying out advisory, management work; directly conduct inspection, examination, and administrative violation handling in accordance with the law or perform the functions and tasks assigned to the Market Management force.

2. Duties

- Develop specific plans to implement management tasks within the functions and duties of the Market Management force; develop plans and projects for inspection and examination in the assigned areas;- Research and resolve issues within authority or advise higher authorities to decide on handling specific issues; inspect and handle administrative violations according to authority; recommend to higher authorities administrative measures to prevent and curb violations;- Monitor, summarize, and promptly report the implementation of inspection, examination, and violation handling as prescribed;- Record official documents, establish case files for violations; compile and summarize the situation, promptly report the implementation of inspection, control, and violation handling as prescribed;- Research and recommend amendments and supplements to mechanisms, policies, laws, and administrative measures to strengthen state management, ensure compliance with the law, and enhance the effectiveness of market inspection and control.

3. Standards of Professional Competence

- Understand the general guidelines and policies; firmly grasp the directions, policies on market management, and related fields;- Possess solid knowledge on the professional expertise of market management;- Grasp the objectives, management targets, systems of principles, and mechanisms of market management and related systems;- Develop plans, projects, various administrative documents, and be proficient in recording official Market Management documents;- Have the ability to aggregate, implement market inspection and control, organize cooperation with relevant units and individuals, and the capability to work independently;- Civil servants applying for the promotion examination to Market Controller must have held the Intermediate Market Controller position for at least 3 years (36 months). In the case of holding the Market Controller staff position, the time of holding the staff or equivalent position must be at least 5 years (60 months).

4. Standards of Training and Further Education

- Hold a university degree or higher in a field relevant to the work;- Have a certificate in state management professional training at the Market Controller rank;- Possess a foreign language certificate of at least level 2 according to the Vietnam's foreign language proficiency framework as stipulated in Circular 01/2014/TT-BGDDT on the issuance of the 6-level foreign language proficiency framework for Vietnam, or a minority language training certificate issued by a competent training institution for officials working in minority areas;- Hold an IT certificate meeting the standards of basic information technology proficiency as prescribed in Circular 03/2014/TT-BTTTT on IT proficiency standards or an equivalent applied IT certificate.
